Helping to secure the blessings of liberty to ourselves and our posterity, this is the Constitution Study on the America Out Loud Network, with your host, Paul Engel.

00:30.90 – 01:00.36

We are witnessing history. Alright, I suppose that's true most of the time, but what's going on lately will be written in history books. Last weekend we had the assassination attempt of a former president who is running to be president again. Definitely a historic event, even before we get into the Secret Service failures. This weekend, a sitting president bowed out of the race just four weeks before his party's convention and just over 100 days before the election.

01:01.44 – 01:37.14

I've been asked about the constitutional issues of Biden's dropping out of the race, but there really aren't any, at least not from Biden. What we see here is both how the political parties have corrupted the election process, especially for president, and the fact that the so-called champions of democracy are about as undemocratic as they come. Hello there, everyday Americans. Paul Engel, here with the Constitution Study, where we read and study the Constitution, teach the rising generation to be free. I'm doing this kind of really quick off the cuff because, well, news breaks.

01:37.74 – 02:06.72

I'm not a news program, right? But this Biden dropout is generating a lot of questions. I wanted to get out and give you the constitutional 411, as well as maybe, I don't know, calm some fears or get some things that people should be looking at, because there's a lot going on here. Now, before this happened, I've been keeping an eye on this. It's in my newsfeed, obviously.

02:07.76 – 02:47.06

We had Joe Biden saying emphatically that he was not going to quit. He was not going to quit. He was not going to quit. And it actually got to the point where, during a Zoom call with 50 delegates just days before, actually just last Friday, a DNC delegate, Elaine Kamarick, said she found an apparent loophole to allow the delegates to not vote for Biden if they couldn't do so in good conscience. Now, again, I find we're talking about, in this case, the undemocratic party.

02:48.24 – 03:04.60

First of all, we know the United States is a republic, not democracy. Not republican, as in the Republican Party, or democracy, as in the Democratic Party. We are a republic. We elect representatives. We don't directly vote on legislation.

03:05.54 – 03:27.96

It's an important distinction. When this country was birthed, we set up a republic. If you read the minutes of the debates in the Continental Congress, they were setting up a republic. They actually saw, shortly thereafter, in the French Revolution, what happens when you set up a democracy. As I think it was.

03:27.96 – 03:49.08

John Adams said, they quickly waste and devour themselves. So we have a party that claims to be the champions of democracy. They're a thread of threats to the democracy, showing right here that they're really only willing to follow democracy as long as they get their way.

03:51.04 – 03:59.42

Now, as I understand it, Kamarick has been on the DNC's rule committee for decades. So she's kind of an insider in all of this.

04:01.48 – 04:23.08

I'm not sure about the rules, but think of it this way. You had the, we had primaries. By the way, primaries are not required in the Constitution. Primaries have nothing to do with the actual election. I know we've been ingrained in this that primaries are not part of the election process.

04:23.80 – 04:41.76

They're part of the party championship process. So you had the Democratic Party held, they had caucuses and primaries, and they got their members to decide who they wanted to be the Democratic Party champion to run for president.

04:44.02 – 05:07.48

And you can't say that people didn't know that Biden had cognitive issues. Granted, they've been getting significantly worse over the last few months. It used to be he would just stumble over words and call people the wrong name and fall upstairs. He'd lose his place. That's been going on for years.

05:08.04 – 05:33.26

Lately, though, Joe Biden's been buffering. He'll be in the middle of a sentence, you kind of pause, like when there's not enough bandwidth for your Netflix stream, and then he'll kick off somewhere else. So I mean, yes, it's gotten worse. But even before Biden stepped down, within the DNC, there were calls. Actually, the call started back after the debate.

05:34.44 – 05:41.96

I'm sorry, I didn't watch the debate. I couldn't waste my time. I had better things to do with my life than watch this play.

05:43.66 – 06:03.14

But just the clips I saw, man, it was bad. And that's when people started calling. Suddenly, now, leadership in the Democratic Party was saying Biden needs to step down. After all the primaries, after the people have spoken, now suddenly we start seeing, oh, yeah, we have to do something about this guy. He's not good.

06:03.18 – 06:14.80

We don't care what the people said. We told the people this is the best guy. The leadership of the Democratic Party said, no, Joe Biden's fine. Joe is strong. Joe is with it.

06:14.90 – 06:20.22

Joe is sharp. You need to support Joe. Don't vote for him. We need Joe. Joe's the only one that can do this.

06:20.30 – 06:30.20

Joe, Joe, Joe. And now, after all the people have voted, now they say, oh, no, anybody, but Joe. We can't have Joe. Joe's going to kill us. No, we can't have Joe.

06:33.06 – 06:45.14

Does that sound democratic to you? Because it doesn't sound democratic to me. So this was going on for a couple of quarters, and we had the assassination attempt on Trump, and all the focus went to that. They weren't really talking very much.

06:46.70 – 06:58.48

And sure, we find out that there was apparently discussions, backroom discussions, or at least some within the DNC about how do we get rid of Joe if Joe still won't step down? And then he got COVID.

07:00.52 – 07:24.68

This was interesting because just before they announced that Biden had COVID, he said, listen, if a doctor tells me I've got a medical condition that prevents me from running, then I will step out. Suddenly, they had their out. Biden opened the doorway. He cracked open the door and said, listen, if there's a medical condition, then I would drop out of the race. Was it?

07:24.68 – 07:54.10

the next day they announced that he contracted COVID for the third time? The man who's been, quote unquote, vaccinated up the wazoo, got COVID again? That's a whole other kettle of fish. But suddenly, they had their opportunity. Joe Biden could bow out without completely losing the face plants he's been doing on Air Force One, without stumbling over his words like crazy.

07:54.98 – 08:05.60

He wouldn't have to go through another debate with Donald Trump. He wouldn't have to be speaking. They just let him bow out. And he did.

08:10.46 – 08:30.08

Now, there are certain sites, I love their headlines. But when the Babylon Bee headline really could be real, sounds like a real headline. I saw this headline over the weekend. Babylon Bee had a headline that said, Dems pull off successful insurrection.

08:32.08 – 08:40.42

Yeah, I was going through my newsfeed yesterday, last night, and I saw that. See, they say the Democratic Party has basically toppled the sitting president.

08:41.96 – 08:47.06

Now, all he's really done, he's not been removed from office, all he's really done is saying, I'm not running for re-election.

08:49.18 – 09:00.08

But think about it. He's not running for re-election because leadership of the Democratic Party has pressured him, in many ways, pressured him out. That's what it appears to be, more than anything else.

09:03.00 – 09:14.94

It's either the leadership pressed him out, or he finally realized just how bad a shape he's in. And I guess the people talking for him convinced him that it's time for him to leave.

09:16.66 – 09:29.24

But again, this is the so-called champions of democracy that have taken the will of the people and said, nope, he's not the right guy. We have to have someone else.

09:31.28 – 10:06.44

Now, again, I've been asked, what are the constitutional issues here? As far as a candidate pulling out, there are no constitutional issues. There may be a constitutional issue, depending on who actually gets chosen. But who gets chosen and how they get chosen has nothing to do with the constitution, because this whole party process, everything up to the conventions, has nothing to do with the constitution of the United States. As I said, there is no constitutional requirement for a primary.

10:07.10 – 10:47.66

There's nothing in the constitution that says we have to have parties, that we have to give parties preferential placement on the tickets, on the ballots. I mean that we have none of that. In fact, the word primary doesn't exist in the constitution until 1964, with the passage of the 24th amendment that says the right of the citizens of the United States to vote in any primary or other election for president or vice president or elected for president or vice president or for senator or representative in Congress shall not be denied or abridged by the United States or any state by reason of failure to pay any poll tax or other tax.

10:50.08 – 11:27.80

Primaries are not part of the process. Primaries are part of the party process and we've been convinced by the parties, in cahoots with our state legislators, to believe that primaries are part of the election process. No, they're part of the process. to take away, or to limit, I should say, your right to vote, to limit who you get to vote for. Primaries are publicly funded elections for private organizations designed to limit your choices on the actual election ballot.

11:28.52 – 11:57.70

Let me say that again. Primaries are publicly funded elections for private organizations designed to limit your choices on election day. They're not part of the constitution, so it has no constitutional issue. Now, as I said, there could be some questions as to the vice president, because Biden, when he stepped down, he.

12:00.20 – 12:25.58

supported Kamala Harris. Now, again, that doesn't mean anything. It's a political statement that he supports Harris. It's still up to the Democratic National Committee to figure out how they're going to decide who's going to be president and who's going to be vice president. I've heard several names thrown out for the, you know, oh yeah, they said that it has to be Kamala, right?

12:25.72 – 12:41.14

How are you going to deny the first Black woman vice president a shot at the presidency? I mean, for the race and sex obsessed Democrats, that would be unthinkable, unheard of. It would be a death knell.

12:42.98 – 12:58.48

Now, again, only because the Democratic Party is racist and sexist, because they care more about the color of a person's skin and their reproductive organs than they do a person's actual competency. Remember, Kamala Harris was a DEI hire.

13:00.28 – 13:08.18

Joe Biden said when he was running for president that his vice president, before he even chose, his vice president, would be a Black woman.

13:10.16 – 13:20.82

She wasn't hired because she was the best candidate. She was hired because she's a Black woman. And for the race and sex obsessed Democrats, how do they simply toss her aside?

13:22.34 – 13:38.26

So then they start looking for vice presidents. And there's a little thing in there that I've heard a lot of people ask. They said, well, they really should choose Gavin Newsom. Gavin Newsom has the personality skills that Kamala Harris doesn't, and they should choose him. But there's a problem.

13:38.34 – 13:50.00

And, by the way, it's the same problem people were talking about with the Trump nomination, when people were saying that Marco Rubio was in the short list.

13:51.70 – 14:12.12

See, under the Constitution, under the 12th Amendment, when it talks about the presidential electors, it says, the electors shall meet in their respective states and vote by ballot for president and vice president, one of whom, at least, shall not be an inhabitant of the same state with themselves.

14:13.80 – 15:04.68

What that means, since Kamala Harris is a resident of California and Gavin Newsom's a resident of California, that means the California presidential electors could not vote for Harris and Newsom, because they are both residents of the same state with themselves, which means one of two things. It means either California has a completely different presidential ticket, another corruption by the parties, or they have to. Either they don't, they have a different ticket where they put someone else up as vice president, which pretty much destroys the possibilities of Newsom being vice president. Remember, they're technically separate elections.

15:06.26 – 15:36.36

Or, because no one's smart enough to actually read the Constitution and realize that, they do put Harris and Newsom on the same ballot. People vote because they can't choose a separate person for vice president. And that certificate, when it goes to Congress, needs to be ignored because it's not a valid certificate. It's not a valid vote for vice president, which means either they ignore the entire thing.

15:38.28 – 15:52.80

Can you imagine giving up all of California's electors? They certainly can't change that. Congress can't change that. So, it would be an absolute nightmare, be an absolute disaster. That's the closest thing I see to a constitutional issue.

15:53.74 – 16:20.46

And I really don't think the leaders of the Democratic Party are foolish enough or dumb enough to do that. I'll talk some more about this after the break. But before I go, if you want to learn more about the Constitution, but you're not quite sure where to start, well, can I recommend the Constitution Study Planning Wizard? I wrote it into the website constitutionstudy.com. And it's simple.

16:20.60 – 16:28.46

You answer a few questions. How hard was it? When was the last time you read the Constitution? How hard was it? What goals do you have?

16:28.98 – 16:52.56

And when you submit it, the system would start generating emails with ideas for you based on your answers. So, by the way, I look at all of them and I may throw in my own two cents if I think there's something unique to that. But it's a great way to just kind of get an idea of, okay, what can I do next to help study the Constitution? Because we're going to need it. We really are.

16:53.90 – 17:07.16

And of course, I mentioned that Joe Biden has COVID. Again, that spike protein is still floating around. We still have shedding. We still have long COVID. COVID, we're not done with it.

17:07.24 – 17:21.42

20:18.00 – 20:34.48

Welcome back, everyday Americans. You've rejoined the Constitution Study. We're just observing the machinations of the undemocratic party. Yeah, they call themselves the champions of democracy, but they actually are about as undemocratic as they get. Now, this is nothing new.

20:34.54 – 20:52.40

Just so you know, this is the party that has superdelegates. In other words, even the Democratic Party doesn't run Democratic primaries. Because, think about it. The people don't vote for their preferred candidate. They choose delegates that are going to vote for their preferred candidate.

20:53.00 – 21:11.96

So even the Democratic Party is Republican. When you vote in a primary, you're voting for a delegate that's going to represent you at the convention and cast a vote. Not you. The delegate casts a vote. And the Democratic Party has these superdelegates.

21:11.96 – 21:37.52

where, in situations, these party leaders can place their thumb on the scales of a choice of the party. And I certainly expect that to come to play now. And this is where people, I think, there may be constitutional issues. These are not constitutional issues. You have to remember, the Democratic Party, just like the Republican Party, is a private organization.

21:37.66 – 21:41.76

I believe it's a 501c3, a tax-exempt nonprofit organization.

21:43.34 – 21:48.90

That means who they choose as their champion is strictly their decision.

21:50.52 – 21:53.64

Now, as I understand the DNC rules as they are,

21:55.28 – 22:16.74

as the vice presidential candidate, Harris has no special dispensation. She's not out because Biden is out. Neither is she automatically going to be considered the presidential nominee because he's out. It doesn't work that way. As you understand, now the Democrats have what's called an open convention.

22:17.18 – 22:26.10

And the delegates will vote until they find a new candidate. They have to get a majority of the delegates to vote for the candidate.

22:28.10 – 23:10.88

Now, according to people, at least according to Ballotopia, I'm sorry, Ballotpedia, the 2024 delegate selection rules for the Democratic Party do not provide any guidance about how delegates should vote if their candidate withdraws. They never thought of this, which is, I think, rather short-sighted. But here's what's interesting. Apparently, 14 states have laws that require the convention delegates to vote according to how they were allocated after the state's primary. 12 states allow delegates to be released when a candidate withdraws or after a specific number of rounds of voting at the national convention.

23:11.78 – 23:52.68

So what we may have are actually not constitutional issues, but we may have legal issues, especially state legal issues. Because, as I mentioned before, the political parties, in collusion with the states, have mangled our election process. The whole idea of parties getting to choose their preferred candidates and listing them on the ballot and not listing others or making it more difficult for others to be listed, nothing with the Constitution. This is all stuff made up by the parties and the states. Now, again, I don't know the rules of the parties.

23:52.86 – 24:00.48

I hate both parties. To me, I just sit back and watch the disaster. I just watch the goat rodeo.

24:02.08 – 24:25.02

Now, maybe they're going to change the rules. Of course, there's a whole bunch of questions. So, for example, the millions of dollars that the Biden-Harris campaign have received in donations, if Harris is the nominee, I believe she gets the money. If she's not the nominee, I believe the money has to go to the DNC. I'm not 100% sure about that.

24:25.06 – 24:25.92

That's what I've heard.

24:28.10 – 25:27.40

So that brings a whole big question of, okay, if you donated money to Biden-Harris, and now that money was given to, if it's given to Harris, somebody, maybe you're not too offended. If you donated to Biden-Harris, thinking you're actually donating to Biden, and Harris was an afterthought, you might be a little upset. But if you donated to Biden-Harris, only have that money sent to the DNC to be given to somebody else, I think I'd be pretty pissed. I mean, how democratic is it for you to donate money to one campaign and have that money given to another campaign, not because of your decision, but because of the machinations of the party elite? Now, as I understand it, if a majority of delegates don't choose a nominee in the first round of voting, they have what's called a brokered convention.

25:27.58 – 26:00.50

This is where the super delegates come in and a lot of other fun and games. Now, as I understand it, there've been 15 what they call multi-ballot democratic conventions where they've taken more than one ballot. The last one was actually in 1952, when it took three rounds for the delegates to nominate Adlai Stevenson. So, I mean, this is a complete mess. And again, it's a mess of the Democratic Party's own making.

26:01.08 – 26:44.62

This wasn't forced on them. This goes back, I mean, remember, in 2016,, Bernie Sanders was the people's choice. He was leading in the primaries, he had the most delegates in the primaries, and the Democratic National Committee used their super delegates and others to basically push him aside for Hillary Clinton, because that's who the elite wanted, the leaders of the party. In 2020, again, Bernie Sanders was leading in the primaries, and all of a sudden we started seeing pressure from leaders in the DNC, and people started dropping out and then pushing their delegates towards Joe Biden.

26:46.40 – 27:34.14

Again, if you voted for Bernie Sanders only to find out, let's say you voted for, well, you didn't vote for Kamala Harris, because nobody, I think, voted for Kamala Harris. But let's say you voted for a Tulsi Gabbard or an Elizabeth Warren, even a Pete Buttigieg, and then had your votes, your delegates moved to Biden. How democratic is that? Because that's what happened in 2020, right? Because, as these candidates left the campaign, they took their delegates and they transferred them to Joe Biden so that he would win, even though Bernie Sanders was leading in the primaries.

27:35.34 – 27:51.90

See, this process is not democratic. It's anti-democratic. It gives the illusion of people having a say, but that say is bounded. It's bounded by the leadership of the Democratic Party. By the way, the Republicans do something similar.

27:52.00 – 28:26.36

They don't do it the same way. The Republicans, remember, we had John McCain was next in line, and Mitt Romney was next. It was always the next in line who the leadership thought could win. Those were the decisions, and they were set up with money and advertising and other support to help promote them to the people, so that the people would vote for the candidate that the party preferred. That wasn't until 2016 when the party wanted anybody but Trump, but guess what?

28:26.40 – 28:37.48

The people really wanted Trump. So this is nothing new. This is not one party. We're just picking on one party, because right now they're the ones melting in front of our eyes.

28:39.38 – 28:54.04

Now, again, what is the party going to do? Are they going to simply take the endorsement of their presumptive candidate, the one who won all the votes or the most of the votes, or are they going to listen to their leadership?

28:55.78 – 29:19.78

See, Politico is reporting that at least four people had private discussions with Nancy Pelosi, saying that if they were to come into this situation, they should have an open nomination at the convention, not the endorsement. They should be open. Let the delegates nominate whoever they want to nominate.

29:21.96 – 29:45.98

That, to me, would at least be okay. Well, it's at least the representative of the people who are making the decisions. But again, if you're a Democrat in the Democratic party who think you're part of a Democratic election, just forget the actual election. in November. You went through what you thought was a Democratic election to choose your champion, your candidate for president.

29:47.26 – 30:03.84

This proves that it's not. It's not a Democratic process. It's a regulated process. It's a process. It's not that dissimilar from what we used to see in the Soviet Union.

30:04.58 – 30:17.84

We didn't see so much in the Soviet Union. What we used to see in, like Iran, Iraq, where, yeah, you had elections, but the only candidates were the ones that the leadership said you could vote for.

30:20.00 – 30:45.80

That's just about what our primary system has become. It's basically what it is. Yes, technically you can write in someone else's name, but the odds are all but infinitesimal that that person stands a chance of even being considered. I mean, the rules in all 50 states are pretty much set up to make it all but impossible for a write-in candidate to stand a chance.

30:47.42 – 31:07.30

Everyone has to spell the name exactly the same. Do they include the middle initial? Do they include the middle name? Most states have to be exactly the same in order to be counted as a vote for this one individual. If you get a thousand voting for Robert F.

31:07.48 – 31:11.46

Kennedy and a thousand voting for Robert Kennedy Jr.

31:11.46 – 31:27.14

, they're not considered voting for the same person. I mean, that's how some of that nonsense... The chances are, again, it's stacked against us. We see now that the whole process is manipulated by the leadership of the party. We shouldn't be surprised.

31:27.28 – 31:31.92

This is not something new, folks. It's something I've been talking about for years here at the Constitution Study.

31:33.52 – 31:52.70

But this, ladies and gentlemen, to me, it's a perfect example. This is one of the reasons why I stepped in to do this special episode. I'm recording this early so that you can hear it, because, to me, again, it's that important. But there's one other thing I think we need to consider.

31:54.50 – 32:11.78

Obviously, this is brought up by this being true to Republicans, although it's not just Republicans I've heard talking about this. They're obviously the ones that are being heard in the media. So the question is very simple. If Joe Biden is not fit to run for president, how is he fit to serve as president?

32:13.80 – 32:21.20

If Joe Biden is not fit to run for president, how is he fit to serve as president?

32:23.18 – 32:42.34

Now, granted, we've heard from. after the debacle of the debate, there have been more and more leaders in the Democratic Party calling for Joe Biden to step down. Well, if they don't think he's qualified to serve four more years, is he qualified to serve now?

32:43.88 – 32:47.40

Again, the problem we run into is political parties.

32:49.52 – 33:37.78

Obviously, yes, if Joe Biden had the honor to say, I'm not fit anymore, and I'm stepping down, we wouldn't have the same issues. This is the man who had to step out of a campaign back in the 80s because he was caught plagiarizing his speeches. This is a man who's lied about his past so often, they're almost to the point you can't count them anymore. So expecting him to simply step down because it's the honorable thing to do, no, I'd be shocked if that were to happen. But remember, after the Kennedy assassination, we put in place a process to deal with incapacitated or otherwise problematic presidents.

33:39.34 – 34:28.32

It's called the 25th Amendment. Section 4 of the 25th Amendment allows for a situation where a president is considered not fit to serve. Section 4 reads, whenever the vice president and majority of either the principal officers of the executive departments or of such other bodies as Congress may by law provide, transmit to the president pro tempore of the Senate and the Speaker of the House of Representatives the written declaration that the president is unable to discharge the powers and duties of his office, the vice president shall immediately assume the powers and duties of the office as acting president. Do you see the problem? So we've gone from an election of president and vice president, which we started in the 12th Amendment, to this party ticket where the party chooses running mates.

34:29.12 – 35:00.94

Now, let's face it, if you are the sidekick to a president, he's got to be pretty serious before you say he's not able to fulfill his duties. And if you look at the president, all of whom probably got their positions because they did something to help the president get elected. These are modernly done by favors. Do you really think they're going to turn on the person that put them in that chair? It's highly unlikely.

35:01.24 – 35:40.76

The same way, impeachment has been politicized, the 25th Amendment pretty much has always been politicized. That's really nothing new, but it shows the problems we have. And these problems aren't going anywhere, regardless of what the DNC does at their convention, regardless of who wins the presidential election in December, folks, not the one in November, the one in December, regardless of who resides at 1600 Pennsylvania Avenue, come January. We're going to continue to have these problems because we've allowed our election process to be compromised.

Welcome back, Everyday American, to Rejoin the Constitution Study. Today we've been looking at the undemocratic party. I want to look at some more election-related information before we close out the day. I don't know if you follow Hans von Spakovsky. One of the most difficult names to say.

39:59.08 – 40:24.88

Actually, pretty smart guy. He's really good to follow. And he made an interesting point yesterday or the other day. He made a point of saying, he said, I think states need to make it clear in their constitutions that you have to be a citizen to vote in all elections in the state to prevent local school boards, local town councils, and others from legalizing alien voting. Now, I found this interesting for a couple of reasons.

40:25.04 – 40:48.34

One is, well, we have the House passing the SAVE Act. The idea of Congress saying you have to be a citizen to vote. And the problem I have is not so much with the idea of the vote. It's that the SAVE Act says to vote in federal elections. Ladies and gentlemen, there's only one federal election.

40:49.30 – 41:15.48

That's the vote that the presidential election electors make in December. No other election is a federal, they're elections for federal office, but they are not federal elections. These are still state elections. And that's an important point. Furthermore, the Constitution only authorizes Congress to change the manner of voting for members of the House and Senate, only members of the U.S.

41:15.52 – 41:32.74

House and Senate, not presidential electors, and certainly not any state or local races. This is a state issue. It's a state power, which is why I agree with Mr. Von Spakosky that this is something the states should be doing and that the state should put in their Constitution.

41:34.32 – 42:04.12

Now, if Mr. Von Spakosky is correct, currently there are only seven states that specifically prohibit noncitizens from voting. They're Alabama, Arizona, Colorado, Florida, Louisiana, North Dakota, and Ohio. And there are eight states that have ballot referendums that would determine whether or not to prohibit noncitizens from voting in their elections. They are Idaho, Wisconsin, Iowa, Missouri, Oklahoma, Kentucky, North Carolina, and South Carolina.

42:05.20 – 42:19.46

So right now, seven prohibit noncitizens from voting. Eight more are considering it. But it's important, I agree with Mr. Von Spakosky, that the states take this and the states deal with it. Forget the SAVE Act.

42:20.10 – 42:44.58

Even if the SAVE Act were passed, it would only be legally binding on races for House and Senate. Not presidential electors, not any others. So let's the states come in and say, no, you have to be a citizen to vote. Now, according to Lorraine Bowman, Director of Communications for the Public Interest Legal Foundation, alien voting in local elections is a huge problem.

42:46.28 – 43:12.72

She pointed out, you know, are the states maintaining voter rolls? Are they keeping separate voter rolls? How are they keeping this data separate so it doesn't get messed up? I think we have a lot of problems in our elections, as illustrated by the fact that, by mistake, aliens are getting registered to vote. Why are they trying to add more in, add to, in, more confusing layers of the system instead of fixing the errors in our election administration that currently exists?

43:13.82 – 43:31.84

I have my opinion, Ms. Bowman, and it has everything to do with political parties trying to maintain power, but that's, that's my opinion. But I agree with Ms. Bowman and with Mr. Von Spakovsky that this is a state issue, and this is an issue that the states should be dealing with.

43:32.28 – 44:23.84

In fact, it's an issue that I'm putting on my list to talk with my state rep and state senator to say, hey, you know, we want to, we should consider a constitutional amendment that says only citizens are allowed to vote in any election held within the state. Now, if we're looking at the Trump assassination attempt, of course, you have the iconic pictures everywhere of, you know, Trump, bloody ear, fist in the air, American flag in the background, surrounded by Secret Service. Do you know what my signature, my, the picture that always comes to mind as I'm looking at this? It's the Secret Service surrounding Donald Trump, as he was standing up, and the one agent that had to reach his hand, his arm, up and over the shorter agent to his side.

44:25.56 – 44:37.58

Donald Trump's a big dude. He's, what, 6'2", 6'3", and they had agents that were just, they were shorter than he was. So in order for him to move, they could not cover him. And watch the video. You'll see.

44:37.58 – 44:58.16

they get her out there surrounding him. They've got him protected on all sides. And then you see one agent raise his arm because he can see Donald Trump's head. They don't want people to see Donald Trump's head. So they, this agent, moved his arm to help cover Donald Trump, his head, because the agent next to him was too short.

44:58.94 – 45:33.12

Which to me leads to a questionable practice within the Secret Service of deciding who gets what detail. If you're not large enough to cover the principal, you should not be in that detail. If you are not fit enough to manhandle the principal, you don't belong on that detail. You can be on another detail. I'm not saying you can't serve, but big guys need big agents, and little people can, you know, smaller people can get away with smaller agents.

45:34.20 – 46:10.68

Which brings me to a very interesting question, one that's, by the way, been around for decades. It's lowering standards for women in certain jobs. Now, again, I'm all for having separate women athletics because there's a physical difference. But if you're talking about protecting a high value target, the President of the United States, how about just protecting your life? I remember as a child, when we lived in New York City, there was a move by some feminist, I can't remember her name off the top of my head.

46:11.08 – 46:16.60

She wanted a lower set of physical standards for fire department members.

46:18.20 – 46:58.44

And the logic, people pointed out that, listen, if you're a fireman, you may have to run to a burning building, pick someone up, and carry them out. If you don't have the physical capability of doing that, should you be the person running into that burning building? And this feminist said, well, if you can't pick them up and carry them, you should be dragging them by their feet, because then their head will be near the floor where there's less smoke, and they'll be able to breathe better. And I remember my father going, yeah, and bouncing their head off the stairs as they're going downstairs. This puts politics above reality.

46:59.74 – 47:27.42

Now, according to the Secret Service Physical Evaluation Tests, if someone under the age of 30 wants an excellent score, they need to do 55 push-ups in one minute. Oh, unless you're, that is if you're a man. If you're a woman, it's only 40.. A good score for men is 40 to 49 demands 28 push-ups, at least 28 push-ups, only 12 for women of the same age.

47:29.08 – 47:43.98

Now, does this mean I want to discriminate against women? No. If a woman can meet the standard, be my guest. As my father said, I don't care if it's a man or woman. If I'm dying in a building, I don't care if they're a man or a woman.

47:44.12 – 47:49.12

I care, can they drag my big butt down the stairs and get me to safety?

47:50.98 – 48:22.28

How crazy have we become? How politicized, how racist and sexist have we become that for the stated goal, a political goal of having 30% female agents in the Secret Service, we're willing to lower the standards not only for the physical test, but for the safety of the protectee, simply to meet a political goal?

48:25.74 – 48:48.32

Again, my point of view, same thing for women in combat. If you can pass the physical test and mental test, and that's what you want to do, go for it. I don't think women should be denied the opportunity, but I don't think they should be favored for the opportunity either. That puts people in danger. Would it have made a difference at the Trump shooting?

48:49.38 – 49:04.62

Well, it wouldn't have stopped the shooting because the shooting happened before the Secret Service agents showed up. If this were not so amateurish, if they actually had multiple shooters from multiple locations,

49:06.24 – 49:37.92

yeah, having the target, having the principal stand up and not be covered by his agents, did risk his life. That can be laid right at the feet, in my opinion, of Director Cheadle, placing the politics of how you look above protecting the principal. Now, granted, Secret Service does more than just protect the protective service, but that's its own issue.

49:39.44 – 50:20.26

Point is, if you're going to put politics above the job, the job is going to suffer. Did that contribute to the Trump failures? I'm not sure, but there certainly were plenty of failures by the Secret Service, and it's something I think the American people need to learn about, because we pay for these men and women to protect their protectees. Yes, the president, the vice president, high-ranking members of Congress, visiting dignitaries, we pay for them. When they fail, we should know why, so we can fix it.

50:21.68 – 50:32.26

I mean, for example, the rooftop that the shooter used, not only was an obvious security risk, it was a known security risk that was not handled properly.

50:33.82 – 50:39.90

Did the Secret Service simply hand it to the local Leo's and then stop paying attention? Why?

50:41.86 – 51:01.52

Why were the Leo's placed inside the building instead of on the rooftop? If the local Leo's were not able or capable of being on that rooftop, then why were they given the assignment? Again, was it politics? Was it resources? And were those resources based on politics?

51:03.80 – 51:14.94

There was this gentleman who was walking around. He was known to the Secret Service. They were following him, wondering why this guy's winding around with a rangefinder and just looking weird.

51:16.98 – 51:18.00

Again, why?

51:19.64 – 51:33.90

And again, at this point, I'm not simply looking. Yes, we're all going to want to cast blame. It's human nature. But I want to find out what the failures are. I want to do that as dispassionately as possible so we can find ways to prevent it in the future.

51:36.88 – 51:43.26

Local law enforcement spotted this guy allegedly around 3 p.

51:43.26 – 51:43.66

m.

51:43.66 – 51:47.68

, three hours before Trump was to speak.

51:49.28 – 52:16.84

And since they didn't have him in custody and they had no evidence that he had left the location, why was Donald Trump allowed in an exposed position, with a potential threat wandering around? Why? The Secret Service reportedly spotted him on the rooftop 20 minutes before Trump went on the stage. Why did they not hold him?

52:18.80 – 52:48.16

Why did the snipers hesitate before they shot? When they saw this person getting in position, they saw that he was assembling, got out his weapon and assembled it. As I understand it, he had disassembled it and put it in his backpack. Why did they hesitate? There may be a very good reason why they hesitated, because some of the communication I've heard is maybe they thought it was actually one of the setting up.

52:48.36 – 53:02.96

I don't know. But there were problems. And if we allow politics to continue to take precedent over finding the problems, we can fix them. All we're doing is asking for this to happen again.

53:05.48 – 53:12.22

So we come back to the, we've been observing the undemocratic nature of the so-called Democratic Party.

53:15.16 – 53:21.30

We've spent a lot of time on that. The question is, does it change how you think about the party?

53:22.86 – 53:25.02

Does it change how you think about both parties?

53:27.94 – 53:41.02

Tell me if you're interested. I want to do a piece, I want to do a segment, maybe two, on how we actually elect the president. Because most people, from what I've heard of the pundits, they don't have a clue.

53:43.08 – 53:55.52

And I think that ignorance is a partial contributor to the craziness we're dealing with with the Democratic Party. And, by the way, with the Republican Party as well. It's the same, we dealt with it in 2016,, we dealt with it in 2020..

53:57.74 – 54:09.42

A lot of this is because we don't know what actually happens. We think we know how we elect the president. We're wrong. I've told the story before. It must be a couple decades now.

54:09.74 – 54:24.52

I was working on a project in North Carolina with an international team. I was the only person, we had. what, eight people there, I think, eight or nine. And I was the only one from the United States. And we were in the middle of a presidential election cycle.

54:25.00 – 54:38.30

So of course, it was on the news. And somebody asked me to explain the Electoral College. And I explained it the best I could. But that was before I'd studied the Constitution. And now I realize I was wrong.

54:38.50 – 54:40.88

I really wish I could go back and tell them the truth.

54:42.70 – 54:57.44

If you're interested, let me know. Go to constitutionstudy.com slash questions. Ask me to do a piece on how we actually elect the president, what the Constitution and laws of the United States say about that. I will be happy to. And I probably will.

54:57.66 – 54:59.14

But I'd love your feedback to be sure.

55:01.26 – 55:10.22

But, most importantly, here's what I'd love. This is a bug I'd like to put in here. Every time you hear someone talk about our democracy or American democracy,

55:11.74 – 55:18.26

understand. they're lying to you. They may not realize it, but they're lying to you. America is not a democracy.

55:19.80 – 55:51.82

The Democratic Party is not a democracy. And this is proof positive, because it's not the people that are members of the Democratic Party that are choosing who their presidential candidate is going to be. It's the delegates and the higher ups in the Democratic Party that are doing this. Even the Democratic Party is not democratic. Yet they'll be out there screaming about needing to protect our democracy from Donald Trump and the Republicans.

55:53.14 – 55:55.04

They're not even a democracy themselves.

55:56.58 – 56:26.62

So no, there are no constitutional issues with Biden dropping out of the race. There may be some legal ones dealing with campaign finance, which is a whole other constitutional issue. There may be some issues with state law about how the delegates can and cannot vote based on state law. But that's a problem of the manipulation of the election process by the parties. But this is not a constitutional issue.

56:27.58 – 56:56.16

It's really an issue of how we, the people, have allowed the political parties to so corrupt our election process, especially the process of electing a president, that we, the people, no longer choose our leaders. They're pretty much chosen for us.
