Get ready to hear the truth about America on a show that's not immune to the facts with your host, Dan Bongino. You have any idea how bad this case has to be? This case against Donald Trump, if they're having trouble, having trouble with a grand jury indictment? I mean, the old adage you're going to die to have sandwich is not inaccurate.

00:25.14 – 00:55.94

If you gave me a ham sandwich, not a big fan of ham or ham sandwiches, for that matter, I couldn't diet it. Oh, I'm sure you have any idea how bad this case against Donald Trump has to be to be having trouble in a grand jury. It doesn't even have to be unanimous, it doesn't even have to be close, anywhere close to being unanimous. I got a big show for the new information about Hunter Biden, all this stuff, economic news out of yesterday.

00:56.28 – 01:07.32

02:07.54 – 02:17.40

All right, Joe, big show today, so let's get this baby going. All right, let's go daddy-o, here we go. You okay, you got pajamas on?

02:18.18 – 02:23.80

You sound a little down, you a little depressed. No, I'm good you were doing something else. Here's the deal, folks.

02:24.36 – 02:40.24

Here's what's going on behind the scenes. We're working on a lot of technical stuff now with the new live chat and everything, and there's a lot of big developments coming with the Dan Bongino show. So actually, Joe, I'm glad we started out that way because stay tuned, you're going to really like it. We're working on a ton of things.

02:40.24 – 02:55.24

I'm really excited about the future of the show, so everybody here is working really hard. I know he wants to tell everybody too, but we got to hold out. I just want to make sure we're working on the tech stuff. You never want to go big with an announcement and then boom, everything flops.

02:55.42 – 03:31.84

Bad move. So again, you have any idea how bad this case has to be? That they were having trouble up in New York City. Twinkies in the Manhattan DA's office getting an indictment on Donald Trump on this stormy Daniels nonsense, right? Let's go through a couple of things because there's a lot of information out there. I got to tell you folks, on both sides of this aisle, the pro-trump side and the lunatic, anti-trump side. There's a lot of information out there that's being sent your way through a partisan lens, but it's not helping people get to the bottom of this whole thing, all right?

03:31.90 – 03:40.40

So let's clear this whole thing up first. Red State Article by Nick Aram. Again, as always, you can read this in the newsletter Bongino.com Slash newsletter. please subscribe, it's free.

03:40.96 – 03:55.52

Reason for the Trump grand jury delay It was delayed yesterday. They sent the grand jurors home on Wednesday yesterday, which is very strange, and said, Hold on, time out, there's a flag on the field. They note the case could be in big trouble.

03:56.60 – 04:23.30

Bragg's office, notably, wasn't commenting on the reason for the delay, of course, saying we don't want to comment on grand jury matters. You expect they're going to say that. But sources familiar with the case told Fox News that the proceedings were canceled amid, quote listen, major dissension within the district attorney's office. One source claimed the DA is having trouble convincing the grand jury on potential charges due to the weakness of the case.

04:25.14 – 04:38.40

Holy Moses folks, do you understand how bad this is? Let's go through the rules of the grand jury fast up. In New York State, you've got 16 to 23 grand jurors.

04:39.44 – 04:50.12

They literally sit in a room. I've testified in front of grand juries before 16 to 23 because people get sick and they sit for a long time. Grand juries don't hear one case, they hear a ton of cases.

04:50.44 – 04:53.52

They'll sit for a long time, weeks, maybe months.

04:55.24 – 05:05.20

16 to 23 people, you have to have at least 16, no more than 23. Like I said, it varies, people don't show up. One day the kid got sick, whatever it may be.

05:06.08 – 05:32.10

Now you may say, what's the process for bringing what they call a true bill? A true bill is an indictment. You just need 12 of them, so think about this if 23 are seated, which I'm telling you in a case like this, listen to me here. I've done this before, involving Donald Trump, a former president, with major, major implications.

05:33.54 – 06:07.24

Every one of those grand jurors is there, I would venture to say there are 21 to 23 seated every single day. Why does this matter again? There's a lot of misinformation and confusion out there about what's happening. If there's 21 to 23 of them out there and you can't get 12, which is barely 55 60, about half of them. Do you have any idea the suck level on your case?

06:08.42 – 06:35.04

Do you know how almost unprecedented this is in a case like this? To waltz it in in front of a grand jury in a liberal city like New York? And you can't get 12 out of 23 people to say not even that he's guilty, that's not what the grand jury. All they're there for is to say, is there probable cause, evidence of a crime? That's it. They don't need, beyond a reasonable doubt, anything, you don't even need unanimity.

06:36.20 – 06:58.10

And they can't even get that now if you listen to the show and the radio show. Joe, remember, we brought this up the other day. I said to you folks, Joe heard it. I said, it is not a guarantee that he is going to be indicted. I said, This case is so bad. Now. Again, this isn't some stygian witches moment where I was like, give me the eye and I can predict the future.

06:58.38 – 07:23.58

I've just sat on grand juries and eventually you have to produce some amount of evidence. The problem is, it's leading to a lot of misinformation from the left. But some confusion on our side too, from people who are having some trouble with the process, which I understand. I mean, if you're, if you've never sat at a grand jury or been a lawyer or law enforcement officer, why would you? You know it's not your thing, you're an engineer, a pilot, you do your thing.

07:23.68 – 07:24.94

I don't know anything about piloting a plane.

07:26.56 – 07:40.88

Here's where the confusion starting on our side. So the confusion on the left is. They thought this thing was lock stock and two smoking barrels. Like Trump's finished grand jury, New York liberal, New York City's done, he's totally done well, maybe, maybe, maybe indicted.

07:40.98 – 07:41.60

He may be.

07:43.60 – 07:59.66

But that doesn't seem to be the case right now. Sent the grand jury home. But on our side, there's been some confusion, too. There is a letter that emerged from the FCC to Trump's lawyer, Michael Cohen, just quickly. The essence of the charge is this.

08:00.46 – 08:33.52

The allegation is that Donald Trump marshaled this deal to pay off this porn star, Stormy Daniels to not talk about the you know, the little the thing they had the liaison, let's say, is that a crime? No? What Alvin Bragg is alleging is that Trump lied about the payment that his lawyer, Michael Cohen, paid Stormy Daniels, which he did. But that Trump reimbursed him for legal expenses. Which are really hush money expenses. You get it?

08:33.52 – 08:42.64

And the Bragg allegation is it's a felony because it was effectively a campaign donation, campaign donation. How the hell is that exactly exactly?

08:42.78 – 09:02.52

That's the point, Bragg's saying. Well, he was trying to further his political campaign by silencing someone who would make him look bad. Folks, it's the dumbest definition of a campaign donation I've ever seen. Hence why the grand jury is having a real problem right now with a true bill. The problem on our side is, a letter emerged yesterday.

09:02.52 – 09:20.34

You can see it here. It's an FCC letter from Michael Cohen to the FCC. Now, Cohen and Bragg are alleging that there was a payoff from Trump to Cohen. You following the gravy train here to reimburse the porn star to shut up in this NDA deal?

09:21.34 – 09:44.50

Well, here's the problem, as you can see from this letter from Michael Cohen's lawyer that emerged yesterday, he says. QuoTe Cohen's lawyer said in this letter to the FCC a while ago that neither the Trump Organization or the Trump Campaign was a party to the transaction with Ms. Clifford. I think, guys, Stephanie Clifford's her name, Stormy Daniels, obviously her screen name, if you know what I mean.

09:45.04 – 09:49.72

And neither reimbursed Mr. Cohen for the payment directly or indirectly.

09:53.12 – 10:04.12

If there was ever a time here, it comes here, it comes. Well, what's that? is it behind me?

10:04.52 – 10:12.12

Oh, it is behind me here. This is time for the birdwell. The Birdwell comes out. It's been a while.

10:15.50 – 10:16.10

Folks.

10:18.16 – 10:49.76

If there was ever in the history of exculpatory evidence, in other words, evidence of your innocence, if there was ever exculpatory evidence in the history of legal cases, this is it. This is the equivalent of me accusing Guy of a murder, and then the guy who I accused Guy of murdering shows up in court. To say I wasn't murdered kind of causes a problem for a murder case. No, hey, I was not murdered by Guy.

10:50.10 – 10:52.06

Well, how do you know that, Sir? Because I'm here.

10:54.44 – 11:11.88

Do you guys follow me here? The gist of the case is that Trump hid the payment to Cohen. He paid him Cohen to shut this woman up. Cohen's lawyer literally signed a letter saying that that didn't happen.

11:17.26 – 11:21.08

So Trump wasn't even a party, he said that.

11:23.52 – 11:28.82

Now there's a possibility. Hold your horses here, I'm a costume maker, hold your horses.

11:29.84 – 12:00.22

There's a possibility, fairly enough, that Cohen, who was Trump's lawyer at the time, was lying to cover for Trump and wrote the letter to the FCC to cover for Trump. But the problem, then is Cohen's a liar. How do you trust anything? This guy said? You get the point? So he's either a totally not credible witness who will lie to the FCC and to his lawyer, or the letter's accurate. And Trump had nothing to do with it.

?Unknown Speaker
12:00.84 – 12:02.02

There's this case.

1Speaker 1
12:03.94 – 12:18.26

Listen, I love Donald Trump, he's my guy. I get it, but I'm telling you in the most objective way, humanly possible. This case is a freaking dog, it's a dog.

12:18.82 – 12:31.70

It is probably one of the worst cases I have ever seen brought against. Forget a politician, against anyone. This is a murder trial where the guy who's supposed to be murdered shows up in court to say hello.

12:34.08 – 12:46.90

Okay, let's get to the part where there's some confusion. It started making its way around social media yesterday. That, gosh, this is a brady violation. We'll get to that later. By the way. That's another topic, a brady violation.

12:47.02 – 13:04.94

What's a brady violation? Brady violations are when the government has information of your innocence and hides it. If the FBI is prosecuting Guy for a bank robbery and the bank wasn't in fact robbed, and the FBI knows that, and they don't tell Guy's attorney that that's it, they're finished. You may open yourself up to civil litigation if you do that.

13:05.42 – 13:23.56

Brady material is evidence of a subject's innocence that the government is obligated to turn over. It's not optional. So a number of people, fairly enough, said, Well, isn't this exculpatory information that should have been presented to the grand jury? And it made its way around the internet?

13:25.26 – 13:28.15

The answer is, that's a convenient argument, but no.

13:30.96 – 13:56.10

No, no, it's exculpatory, I just explained that, but folks, that is the point. What do you mean? The grand jury, these 23 grand jurors that sit the government prosecutor? In this case, the DA's office in Manhattan has zero obligation whatsoever in there to present exculpatory information.

13:56.56 – 14:02.72

How did I open up the show? What did I say? Guys? I said, you couldn't die at a ham sandwich, that's how it was. Just put it on the internet.

14:03.02 – 14:15.14

Put it on the search engine. Die at a ham sandwich. People have been saying it for decades. Why? Because the government prosecutor goes in there and can say basically whatever evidence they want without giving the exculpatory evidence.

14:15.44 – 14:22.06

Now that'll come up in discovery and at trial, but not in the grand jury. Now let's tie it all together.

14:23.96 – 14:43.72

How freaking bad is this case, folks? That the government, the DA's office, had no obligation to even disclose this? Now everybody knows it's out there, didn't have to disclose it, should have, but didn't. And they still can't get a true bail and indictment.

14:45.94 – 15:18.20

Can you process the shock level on this case? That they've got information sitting out there that the guy who's supposed to be murdered is still alive? They withhold it from the grand jury while going in there making this murder case and not telling the grand jury any of the stuff about how bad the case sucks. And they still don't agree. Now, if you're a sane person, unlike Twinkies in New York, right? Because the guy's clearly been eating too much and it's polluted his frontal lobe, okay?

15:18.84 – 15:41.54

If you're twinkies right now, and you know, this letter's out there entirely. Absolving the defendant in this case, potentially Donald Trump, of guilt in this, and you haven't yet disclosed it to the grand jury. If you're smart, which twinkies? Isn't one of the dumbest human beings ever to occupy any law enforcement position in the United States?

15:43.30 – 15:54.30

Oh my gosh, monarch of the stupids, emperor of the imbeciles. You go forward with the case, push through, keep going back to the grand jury over and over.

15:54.68 – 16:14.96

That's why I told you, folks, you think this case is going to hurt Donald Trump. Donald Trump is going to walk out of this. There's zero chance, zero chance that, whether through the appeals process, at the end of the day, that this verdict say it is guilty, which I'm not even sure it would be. If it even goes to trial. If they even get out of grand jury, there's almost zero chance Donald Trump doesn't come out victorious in this in the end.

16:17.00 – 16:27.04

You get my point here, don't fall for the exculpatory evidence trap. here it is exculpatory. However, the D.A. has no obligation to put that in front of a grand jury.

16:27.04 – 16:40.38

That starts at discovery and at the trial process, not in a grand jury. That's why you couldn't die at a ham sandwich. You don't have to tell the grand jury anything about the subject being potentially innocent, that's the whole point.

16:42.52 – 17:12.72

And they still can't get him. Now, even the hardcore lefties, some of them, are starting to wake up that this is going to be a disaster. Some of them, 99 of tyrannical left wing communists, are just straight up imbeciles and want to see Trump in handcuffs. Even though they know it's going to blow up in their faces because they're idiots with no sense of response consequence. Here's Van Jones yesterday on CNN Here's Van Jones starting to quit.

17:12.88 – 17:28.64

I mean, the guy's liberal bona fides aren't in question. Right here's Van Jones saying, Dude, are we really sure we want to go forward with this? This Manhattan D.A. Better wake up soon because this case probably isn't that great. Take a listen.

17:28.74 – 17:42.20

I think that the heat is on this, da? I think he's going to make a very sober decision and I would not be surprised if he doesn't step back from the brink. Now. Of course. Jones, I'm no fan, I mean, he's no fan of mine either.

17:43.42 – 17:59.40

Jones is just saying the truth, whereas I just told you the truth. About the exculpatory evidence thing. Don't go on Twitter. Oh look, they withheld the exculpatory evidence from the grand jury. Because I don't want you to get burned because it makes your credibility look bad. He doesn't have to do that.

18:00.32 – 18:08.48

The left doesn't care. They don't want the truth like, I'm giving you, they don't want to. They want to be told one thing and one thing. Only you guys know what it is.

18:09.06 – 18:15.50

Donald Trump lock him up, hang him by his toenails, they don't care, shave his head, put him in prison, mug shot.

18:15.50 – 18:33.96

They don't care, so Van Jones is stating the obvious this case is a dog, an absolute dog. They don't want to hear it. Here's Illy Mistel, that lunatic from MSNBC, another guy with a Twinkies problem.

18:34.28 – 18:46.58

Maybe him and Alvin Bragg eat at the same place. Here's another Twinkies guy, the fatty acids clogging up his neurons. Here he is, he tweets. In response to this, Van Jones is the Tim Scott of Maggie Habermans.

18:47.18 – 18:57.42

And Ed Mueller? She wrote a hilariously stupid podcast that actually believed the Mueller probe was going to find collusion tweets back. Omg, haha.

18:59.68 – 19:05.84

I remember Politicon once they asked me to be on their podcast, I was like, Ha, yeah, sure, maybe tomorrow.

19:07.78 – 19:15.96

It's true, they know what happened. I had no idea who they were. Mueller What the heck is that people take Mueller seriously?

19:17.60 – 19:38.22

Folks, the Libs are losing it. They are completely detached right now from legal reality, from political reality, anything else they don't realize right now. That the reason Donald Trump, I'm telling you I'm getting this from, Listen to me, listen to me quick, please, I'm getting this from the most reliable of sources. Trump's not afraid of this case.

19:38.22 – 19:45.48

One bit you may think he is may make you feel better. Oh, we got him now, Joe, the walls are closing in. Guy, they got him now.

19:45.84 – 20:03.26

Walls are closing in. You may think so, but I'm telling you, right now, Trump isn't the least bit afraid of this case. He knows it's a dog, and he knows he's going to have his moment walking out of the courthouse, shaking his fist in the air. As he's victorious in this case, he knows it, and he knows you guys are setting yourselves up for failure.

20:04.90 – 20:22.62

Folks, the Democrats have been salivating for years, too, over an indictment of Trump. It's really pathetic. I got a supercut of that coming up in a second, and then is the next shoe to drop here? In this case, the White House involvement in this was the White House involved in pushing Twinkies to try to charge Donald Trump.

20:23.00 – 20:36.62

Because then we got a real problem. Let's get to this first. Patreonmobile.com slash Dan. Americans have had it. They're done supporting companies that rake in hundreds of millions, billions of dollars off us, and then turning around and screwing us by supporting woke left-wing causes.

20:36.76 – 20:59.74

You know, we used to have to take it, but we don't anymore. Parallel economy companies like Patriot Mobile are building a whole new economy. 21:23.18 – 21:46.02

We got to stand together, folks, and support companies that share our value. Patriotmobile.com Slash Dan or call 878-Patriot. Thanks, Patriot Mobile. So the Democrats, this is a hat tip. Tom Elliott over at Grabien have been salivating for years over an indictment of Donald Trump. It shows you why tying this segment up, why what I just said matters.

21:46.80 – 22:09.22

They are completely detached from any kind of legal or political realities, their case is a legal dog. It's an even worse political one because Trump is going to beat them, and they're going to martyr the guy and make him look like a superhero. Karl Rove wrote a piece yesterday at the Wall Street Journal, suggesting otherwise that this isn't going to politically help Trump. I entirely, completely disagree.

22:09.92 – 22:20.90

Sometimes I agree, sometimes I disagree with you, completely disagree. I think he is totally misreading this situation, and I say it as a guy who really loves the Florida governor.

22:20.90 – 22:39.32

And I like the former president a lot. I'm being objective as possible, I think he's totally misreading this. This is what the Republican base sees when they see Trump fighting the deep state. And when he wins this, they're going to see it as a victory over these people.

22:39.42 – 22:39.84

Take a look.

3Speaker 3
22:40.88 – 22:44.00

It's clear that Trump is the target and he'll be indicted eventually.

1Speaker 1
22:44.24 – 23:01.44

On the day Donald Trump leaves office, the Justice Department may indict him. Now there is talk of jail time for the president, that Mueller could indict the president for obstruction of justice. Donald Trump should be indicted for calling a cooperating witness a rat. he should have been indicted.

23:01.58 – 23:14.14

A sitting president can be indicted by the Justice Department. Why aren't we at the target, Trump having committed crimes to get the presidency? so why aren't we at an indictment yet? I think there's generally consensus.

23:14.14 – 23:26.20

The president has probably committed indictable crimes. It's very strongly in favor of indicting the president when he is out of office. That there may be enough evidence to indict Trump. Is Donald Trump going to be indicted? Maybe it'll happen.

23:26.52 – 23:44.80

Maybe he'll go to prison. Will you ever see the inside of a prison cell? Da could get a ham sandwich indicted. Hey, listen, Trump's the big Mac. Even if Donald Trump himself is not ever indicted, there is another way that prosecutors can actually indict the entire Trump org.

23:46.32 – 23:58.20

Now Joe cut that that video is three minutes and 30 seconds, three minutes and 30 seconds long. You can go to Tom Elliott's Twitter feed or Grabian and take a look yourself. It goes on and on from 2018 all the way up till now.

23:59.08 – 24:19.10

Democrats just, you know, blood from their fangs salivating, foaming at the mouth, rabid-like begging for a Trump indictment. Again. Back to my point, it has detached them from reality. They have lost, They have totally lost their bearing on. They're in the matrix now.

24:19.96 – 24:47.66

They're in this false reality where they think they're going to legally or politically hurt this guy. They may legally cost them a lot of legal bills, but the cases against them, whether it's Georgia and classified documents or this, are all dogs. The classified documents case only brings attention back to Joe Biden, who has got a far worse scandal. The Georgia case keeps bringing attention back to people who have a lot of questions about what happened to Georgia. And this case just keeps highlighting Trump's war with the deep state.

24:48.22 – 24:59.32

None of this is working. Here's the next shoe to drop. By the way, read this piece by John Solomon. The House Judiciary Committee is probing whether D..C. Democrats intervened to pressure Twinkies to charge Trump.

25:01.28 – 25:17.16

Oh boy, that could be a problem. That could be a real problem, especially considering the Department of Justice decided not to prosecute this case against Trump. Because they knew it was what fellas, a dog, a dog.

25:19.32 – 25:39.64

Now, as I said to you yesterday, I'm very concerned about our Republic, and you should be too. You need two things for a social revolution, and I don't mean this revolution in any kind of a qualitatively positive way. I'm talking about societies collapsing and violence in the street.

25:40.60 – 25:53.44

You need two things for that to happen. Generally speaking, I mean, imagine the worst possible scenario, neighbor against neighbor, no police, civil war in the streets. Imagine that horrible, right?

25:54.44 – 26:11.82

You're never going to get there in a prosperous country like the United States, without two things number one faith in institutions collapsing. People don't do this stuff because they're afraid of the police and being arrested, They're afraid of a military crackdown or the FBI investigating them. That's a good thing.

26:11.88 – 26:25.66

We don't want civil war in the streets, you want people killing their neighbors, obviously. I mean, does that even require us saying that? But you have faith in institutions, and you believe like your neighbor's not going to come after you either. Even if they're a Democrat and you're a Republican, because we have laws.

26:25.98 – 26:40.10

And we have what faith in institutions? When you see societal upheavals, people lose faith in institutions. Oh, the FBI's not going to protect me, matter of fact, not only are they not going to protect me, they're going to target me because I'm a MAGA supporter.

26:41.92 – 26:51.74

That's happening now. I just described to you how nobody has any faith in this justice system anymore. NEW YORK CITY You're a sitting duck. If you're a conservative, why you'd stay there is beyond me.

26:53.58 – 27:08.58

The second part you need is not just faith in institutions collapsing, you need economic collapse because you need to make people desperate once they're desperate. Only four missed meals away from chaos, right? That's the old line. Civilization's a thin crust on a volcano, right?

27:08.62 – 27:25.02

It's been said before, once you get to economic collapse, you've got this witch's brew for a dangerous societal upheaval. Folks, it's happening right now, you've got this perfect storm going on right now, as the Fed raised rates again yesterday 25 basis points.

27:25.64 – 27:36.50

The economy is teetering on an edge that broke after the podcast yesterday. We have a lot of trouble. But back to the faith in institutions part in a second.

27:36.84 – 27:51.14

This has been a multi-day part. I've been covering these over the last couple of days because I'm very worried about it. You want to see why faith in institutions is collapsing. Well, you're probably saying to yourself, Oh, well, you know what? Even if Twinkies indicts them, our institutions will hold Joe.

27:51.24 – 28:01.12

You know, we got courts, we got judges. judges are just guys and ladies in black robes. And they're not partisan at all. And they know the law and they understand the law, and they'll back us up.

28:01.28 – 28:18.38

Of course, that got thrown out of the way with January 6th, where guys have been sitting in gulags for two years despite habeas corpus. Yeah, oh yeah. They've had initial appearances, but they've been kept in prison for absolutely absurd, absurd reasons. Nobody has faith in the judicial system anymore.

28:18.50 – 28:36.00

People are losing it. How do you expect to get a fair trial as a conservative in front of this guy? Let me introduce you to a man named Cato Cruz who is being nominated for a court seat by Joe Biden. He is a federal magistrate now.

28:37.12 – 29:10.94

He's asked a pretty simple question about brady material, Brady material, you know? Like, we've been discussing for the last three weeks and everyone else has been discussing in the media. It's evidence of a defendant's innocence that's not presented to him, i...e. the FCC letter from Michael Cohen's lawyer to the FCC about the payment Donald Trump didn't make, according to the letter. Brady material is a concept taught to a law enforcement officer and a 101 law student in college.

29:11.60 – 29:25.42

This is not a complicated thing. So a federal magistrate, you guys think they know a little bit about brady material? It's like asking, Joe, Joe, you know anything about processing sound? No, not nothing. You want to be the sound engineer?

29:25.64 – 29:39.60

I'll figure it out, no, we're actually looking for someone with some skills. Listen to this. Here's Cato Cruz responding to Senator John Kennedy, Republican from Louisiana, who asked him a simple question What's Brady material?

29:40.00 – 29:40.66

Check this out.

3Speaker 3
29:40.66 – 29:42.88

Tell me how you analyze a brady motion.

1Speaker 1
29:44.74 – 29:47.70

How I analyze a brady motion? Yes.

29:49.58 – 29:58.76

Senator, in my four and a half years on the bench, I don't believe I've had the occasion to address a brady motion in my career.

3Speaker 3
29:59.04 – 30:00.94

Do you know what a brady motion is?

1Speaker 1
30:02.36 – 30:19.52

Senator, in my time on the bench, I've not had occasion to address that, and so it's not coming to mind at the moment. What a Brady motion is. Do you recall the U...S. Supreme Court case? Brady v. Maryland? I do recall the name of the case, Senator, Yes.

30:19.66 – 30:20.80

And what did it hold?

30:22.56 – 30:29.80

I believe that the Brady case Well, Senator, I believe the Brady case involves something.

?Unknown Speaker
30:29.80 – 30:33.46

Regarding the Second Amendment, it is not. I have not had occasion to address that.

1Speaker 1
30:33.54 – 30:59.10

If that issue were to come before me, I would certainly analyze that Supreme Court precedent and apply it as I would need to to the facts in front of me. Thank you, Mr. Chairman, you're a federal magistrate who confuses the Brady v. Maryland case again. A case taught to a first-day FLETC student training to become a TIGTA agent for the I.R.S.

31:01.08 – 31:15.84

Federal Law Enforcement Training Center FLETC, as they call it, you're confusing one of the most important cases in American history, Brady v Maryland with the Brady Bill, he told you, Brady v Maryland.

31:16.60 – 31:18.34

You don't even know what it is.

31:20.80 – 31:25.14

That's like not understanding the significance of Marbury versus Madison.

31:27.22 – 31:38.12

Folks, this is embarrassing and I'm just putting it out there. I'm not a Biden supporter. Obviously, you don't need an explanation there.

31:39.64 – 31:55.06

But, like, I would expect to get a fair trial in front of a judge, even if they were a Biden or Obama appointee. I would give these guys a fair shake too. Maybe they are good guys, maybe they're not. I'm sorry. That's automatically disqualifying, automatically disqualifying.

31:56.40 – 32:26.38

There is no way anyone should vote to put this guy through if he has no idea what exculpatory evidence is. It's not like we just had this conversation about the Qanon shaman and about Michael Cohen. I mean, all the guy had to do, Joe is turn the news on. Where the idea of exculpatory evidence and brady material comes up every day. The January 6 videos of Jacob Chansley, the QAnon shaman, being escorted around by police, Brady came up. All you have to do is put the news on.

32:27.86 – 32:45.16

You think you're going to get a fair trial in front of this guy? are you crazy? Zero chance. This guy was clearly chosen for ideological reasons and not his knowledge of the judicial process. And I loved watching lefties defend this stupidity.

32:45.40 – 32:50.56

If that was a Conservative nominee, forget it, they would have went crazy.

32:52.32 – 33:16.04

They don't care, all right, let me get to my next sponsor. I want to show you something else because the January 6 case, by the way, has gotten very, very strange. And it's curious how many so-called civil libertarians on the left are staying real quiet about an explosive new allegation about FBI sources. You'd think they'd care about this stuff.

33:16.08 – 33:17.02

You know the law and everything.

34:53.78 – 35:27.52

All right, so the craziest thing is, again, brady material is all over the place. The January 6th cases, the Mike Flynn case, the Michael Cohen-Donald Trump case. If this guy Cato Cruz, this judicial nominee just turned the news on, Joe hit the power button on the remote, he would have learned what Brady material is. Now. This is coming up again. Because one of the defendants in the January 6th case, who was charged with all kinds of things. You know, felonious, smokery and the umpteenth degree, and all these other charges and everything else.

35:28.02 – 36:22.90

One of the defendants, his legal counsel, just filed a motion and he makes a suggestion in here that I got to tell you. I was communicating with a former FBI friend of mine yesterday about this and he said to me, I have never heard anything like this. It reminds me of that scene in that movie Seven, with Morgan Freeman and Brad Pitt. They're investigating the serial killer, and he whispers in his ear, Have you ever seen anything like this? The answer is no. The lawyer for one of the defendants in the January 6th case is implying that an FB.I. confidential source doesn't mean it was an FBI agent. It could have meant it was someone who had infiltrated their group or someone they flipped. Quote participated in prayer meetings with members of one or more of the defendant's families.

36:23.78 – 36:32.34

The CHS confidential human source also engaged in discussions with one of the defendant's family members about replacing one of their lawyers.

36:33.92 – 36:50.16

The above may not include all the communications that were initiated by or engaged by the CHS. Folks, listen again, please, I promise you objectivity in this matter. I am not subjective, I am a conservative, I believe in conservative principles.

36:50.52 – 37:07.18

I promise you objectivity in this matter. I am putting all of that aside. To tell you, as a former federal agent myself, I have never heard of anything like this. Let me just sum up first, you know what? Let's play Christopher Wray first. Maybe it explains this.

37:08.04 – 37:25.78

Here's a video he's being questioned by a Republican congressman. This is months ago. FBI Director Christopher Wray asked specifically about this Did you or did you not have FBI sources? Inside the January 6th crowd, the Proud Boys and other entities that were there that day.

37:26.08 – 37:42.92

Listen to the shady, slimy answer he gives, which should have sounded the alarm early. Check this out. And that there's a suggestion, for example, that the FBI's confidential human sources, or FBI employees in some way instigated or orchestrated. January 6th. That's categorically false.

3Speaker 3
37:43.08 – 37:50.76

Did you have confidential human sources? Dressed as Trump supporters inside the Capitol on January, the 6th, prior to the doors being opened?

1Speaker 1
37:51.18 – 37:53.66

Again, I had to be very careful. It should be a No.

37:55.58 – 38:08.08

Pretty much a yes or no answer, right? Julie Kelly, Darren Beattie. That was from the Laura Ingraham show. They've been on this story for a long time now. To liberals out there who listen to my show and want to send me death threats and everything, I know how you are.

38:08.78 – 38:26.04

Just for a minute, you know? Take the cotton out of your ears and stick it in your mouth. Do you understand how devastating this is? How, if you continue to support this, this situation could degenerate quickly and turn around and ensnare you. It's really amazing, Joe. Remember the whole infiltration of the Black Panthers thing in the late 60s and 70s?

38:26.08 – 38:52.60

They went crazy. The CointelPro Oh my gosh, how awful. It's amazing how when it's a left-leaning group like the Black Panthers that ascribes to these socialist principles, the left loses their mind with what they declare the FBI heavy hand. Now that it's pretty clear the FBI had a source inside of some of these January 6th defendants groups, the left loves it.

38:52.66 – 39:02.28

They think it's the greatest thing ever. Now, let's be clear there's nothing wrong legally, but morally, it's up to you, you judge it however you see fit.

39:02.28 – 39:08.10

There's nothing wrong legally with the F.BI using sources to get information, as long as it's not obtained illegally.

39:10.00 – 39:29.84

However, there is something administratively unquestionably wrong, and they are going to have a real problem if these allegations are true. That the FBI developed the source inside this proud Boys network and was giving somehow legal advice to the families.

39:34.94 – 39:43.48

Keep supporting. Where's the ACLU on this one? Where are you guys? You understand how bad that is, imagine it, right?

39:43.52 – 40:06.82

Joe's got a group of people that robbed the bank, right? So he robbed the bank. And the FBI's had a source in there, paying off one of the guys to give them information the whole time about the bank robbery. Joe's then in prison, and then the same guy who the FBI's using as a source. Is showing up with the family and getting the legal strategy from the lawyer that's going to defend Joe in court.

40:09.08 – 40:22.42

Wait, what are you crazy? I'm talking to this FBI guy yesterday, Joe on Signal, and he's like, This is by far the craziest thing I've ever heard. And I've heard a lot of crazy labels. This is nuts.

40:24.18 – 40:45.86

Now you see why I'm worried about the witch's brew of the economy collapsing. At the same time, faith in institutions is totally eviscerated. You're going to trust the FBI after this debacle, you're going to trust a court system with a guy who doesn't even know what a freaking brady case is. Now. Combine that with this, the economy going down in flames.

40:45.86 – 41:03.70

At the same time, we now have two choices. Folks. With the economy moving forward. Fed Met yesterday bumped up the rates 25 basis points, you can see at the Washington Times. Fed raises rates, declares sound banking system. Oh yeah, they declared inflation was transitory, too.

41:03.96 – 41:07.70

I don't know about that. I'm going to take that and stick that right in the toilet bowl.

41:09.34 – 41:19.22

Fed's got an interesting problem right now. I summed it up for people yesterday. I see it made its way around Twitter. A lot of people were saying, Hey, listen to Dan Cho, he sums it up. Here's a choice right now we have in the economy.

41:20.12 – 41:29.76

There's a third choice, but it's not an option because Joe Biden's in charge. I'll get to that in a second, but we have two choices right now in the economy, and only two with the Democrats in charge.

41:31.14 – 41:36.98

You're going to have hyperinflation or a bank collapse or both.

41:38.60 – 41:58.10

There's a third option to fix this right now, but the Democrats won't take it. Let me get to my last sponsor and I'll get to. I'll explain exactly what's going on, why you should be concerned. And a guy on Fox explained it really well, what's going on right now, why we're in a little bit of trouble. Brickhouse Nutrition folks, I am a big believer in Field of Greens.

41:58.58 – 42:14.60

It is a fruit and vegetable powder by Brickhouse Nutrition. You can get it at brickhousenutrition.com. Slash Dan Use promo code DAN for 15 off. Listen, here's the story. The owner of this company, I am a big believer in the power of fruits and vegetables.

42:15.28 – 42:30.84

I am a huge believer. I get my blood work done all the time for obvious reasons, and the doc says to me, he says, Listen, you got the blood work of a 20 year old. That's because of diet and exercise, both, but my diet would be lost without Field of Greens because I don't always have time to prepare.

42:30.84 – 42:49.94

Every day, especially between, shows, a big cornucopia of colorful fruits and vegetables. So I asked the owner of the company if he could make a product so he took the most wholesome, best organic fruits and vegetables. They grind them up into a great tasting powder, and it goes into a jar of field of greens. Take a scoop, put it in whatever beverage you want.

42:50.56 – 43:01.30

Protein shake, water, green tea. I put it in, sometimes, stir it, drink, tastes great. He loves the lemon lime, I drink the wild berry. I don't eat as healthy as I should.

43:26.34 – 43:33.62

Take care of your health that goes away, nothing else matters. Thanks, Brickhouse. So pick your poison right now.

43:34.22 – 43:44.12

The Feds got to raise interest rates because they've got to dry up the money supply. interest rates go up. It makes money more expensive, right? Everything has a price. bagels, cars, money has a price, too.

43:44.54 – 44:05.86

For you to get money at a bank, you got to pay an interest rate, right? The higher the interest rate, the harder the money is to get. Well, I can't afford a 9 loan, but I can afford a 5 loan. Think of an interest rate as a price of money, kind of the price of capital. But for sake of argument, in order to dry up the money supply and make money harder to get, the Fed raises interest rates in inflationary periods.

44:06.72 – 44:27.80

Okay, that's a great idea. We're in inflation. What's the problem, Dan? The problem, as I've said for the last week, is as the interest rates go up. The banks all have a bunch of bonds on the books that lose money when interest rates go up. No one wants a bond paying 2 if I can get a 5 bond because interest rates go up.

44:27.92 – 44:42.08

Very simply stated. So what you're saying, Dan, is, as the Feds keep raising rates, banks are going to continue to lose money. Isn't that going to cause a banking crisis? Yes, that's the point, man. So there's a third answer here.

44:42.08 – 45:09.24

The third answer is to do what Reagan did, and to juice the economy by cutting government spending and massively cutting taxes, letting the economy grow. Which would produce more products, which, like a sponge, would suck up all the money because it'd be chasing more products and prices would come down. That's out of the question. Biden's a communist, doesn't want to do that. So what's going to happen, folks? Well, I'm telling you, either hyperinflation is going to happen or you're going to see more banks going down.

45:09.24 – 45:21.40

Here was a guest, Eddie Gabor, on Fox yesterday, explaining exactly the problem we're in now. Check this out, All right, Eddie. Does backing up the banks make any difference to your bearish outlook for stocks?

3Speaker 3
45:22.84 – 45:48.72

It does not look. The fact that Yellen has to even come out and say that there's a potential to need to backstop. More banks, in my opinion, gives people less confidence in these smaller banks, and so we have a banking crisis, unfortunately. And look, this goes well beyond the banks, right? Think about the financial institutions that aren't backed by FDIC, the shadow banking that have these same types of high-risk loans that are out there.

45:48.88 – 46:16.78

They're going to start to see defaults there and there won't be any government backing. Look, at the end of the day, the government can't backstop every business and every bank and every depositor, right? This is a function of poor monetary policy and loose and zero interest rates for over a decade. And we just started this banking crisis a couple of weeks ago. Just because Yellen comes up and speaks about it doesn't mean it's going to reverse itself overnight.

1Speaker 1
46:18.20 – 46:40.84

This guy just absolutely nails it, he absolutely nails it. It's not just the banking system that's in trouble, it's the shadow banking system. What's the shadow banking system? A lot of these companies that aren't going to be able to get loans from standard banks. Joe, because they got a product that may or may not work, and they're new and they have no reputation in the space. They go to this venture capital angel investor space, who lend them money, too.

46:41.58 – 47:04.98

A lot of them are going to have problems as interest rates go up, too, and money starts to dry up. This entire shadow banking system that's interest rate sensitive has the same issue the banking system does. A lot of these companies that were going to go public or not? A lot of these companies that are public. And have been borrowing money at low rates and have bonds on their books, their bonds are going to be worthless. Now, you see why I'm a little worried.

47:06.22 – 47:14.76

I'm worried, very simply because the witch's brew for social revolutions economic trouble. At the same time, faith in institutions collapses.

47:16.46 – 47:18.76

Sounds like something is happening right now.

47:20.34 – 47:42.10

Speaking of faith in institutions collapsing, you see this email, the America First Legal Foundation. They got this email from Kate Bedingfield when she was working at the VP Office. Biden Look at the date 2015 Biden's the vice president. This is hilarious, she's answering to Eric Schwerin, who was one of Hunter Biden's business partners at Rosemont, Seneca.

47:42.36 – 47:54.80

They're talking about making the Hunter Biden story go away. She was, absolutely, this is in the VP's office, she says. Absolutely. We've had two conversations about it. She's talking about her conversations with someone from the press.

47:56.02 – 48:13.30

She will only use the press if her editors hold a gun to her head, she absolutely will not do the second thing. Talking about covering these past stories about Hunter Biden and his time in the Navy and his corrupt business deals. You think we're going to get honesty from the Fourth Estate and the media?

48:15.12 – 48:33.16

You have someone in the media telling the VP's office they're not going to actually cover the bad news about the VP. Unless they quote, have a gun to their heads. You think you're going to get honesty from the White House? Here's Kareem Jean-Pierre, anyone changing their vote in advance, He Joe, anyone? Worst press secretary in the history of the United States by far.

48:33.72 – 48:57.52

She's asked yesterday by Peter Doocy about this unfolding disaster of the Biden mafia, corruption, ink racket and the new information from bank records about Hunter Biden. Keep in mind, these are bank records, no one's disputing the authenticity of them. And the Kareem Jean-Pierre defense is the Beavis and Butthead defense, the infamous cartoon from the 90s.

48:58.20 – 49:00.06

The other kids did it defense.

49:02.44 – 49:07.34

The what me defense here listen to this. Thank you Kareem.

3Speaker 3
49:07.78 – 49:10.28

House Oversight says they've got bank records.

1Speaker 1
49:10.28 – 49:12.34

Showing a Chinese energy company.

?Unknown Speaker
49:12.34 – 49:14.42

Paying three Biden family members.

1Speaker 1
49:14.42 – 49:31.98

Through a third party, what were they paid for? Look, I'm just not going to respond to that from here. Look, we have heard from House Republicans for years and years and years, how, how, the inaccuracies and lies when it comes to this issue.

49:32.60 – 49:47.14

And I don't even where to begin to even answer that question. Because, again, it's been lies and lies and inaccuracy for the past couple of years. And I'm just not going to get into it from here. This is really stunning defense how the media lets us go.

49:48.66 – 49:56.94

They have the bank records, just like they have the laptop. Nobody's disputing the authenticity of either one, nobody.

49:59.38 – 50:10.80

And they still are going with. It wasn't me defense. And the media obviously doesn't care. Unless you quote the Kate Bedingfield's email, they will not print it unless you put a gun to their heads.

50:12.38 – 50:23.14

This is just insane. By the way, I got to get to these stories. Questions for tomorrow. If you want to submit questions for tomorrow, ask we do ask me anything tomorrow. On Friday, go to my Locals account.

50:23.48 – 50:30.48

50:30.80 – 50:37.02

Say questions for Dan, Submit a question for tomorrow. But I want to get to this. I've been holding it for a couple of days. First, as I've said, what's old is new.

50:37.02 – 50:46.02

Again, with the left, Joe, segregation is back with the left. now we can take another vote, segregation, Joe. Good or bad thing, bad, Dan.

50:46.54 – 50:56.00

Guy, Guy's giving it a thumbs down. That's a three for segregation. Definitely no good, as I told you, though, the Libs want to bring it back.

50:56.56 – 51:11.40

Grand Valley State University lists their graduation ceremonies for Black students, Asian students, Latinx students, and Native American students. Next month. They'll also have a general commencement for all students when they're done with segregated students.

51:14.20 – 51:24.24

Segregation is back with the left. Here's a video, too. I haven't shown you yet. This is Lydia Glaze. she's a state representative in Georgia. Here she is about school choice.

51:24.32 – 51:38.86

They want again segregated schools, poor minority students in crappy schools. She's a Democrat, of course. They want poor minority students in crappy schools, and they want white and other students in other schools. So this is the Democrats arguing.

51:39.32 – 51:48.60

And here's Lydia Glaze, state Rep. in Georgia, arguing against school choice, saying you, parents, you're just too stupid to figure it out. Kind of similar arguments that are made by racists all the time. Check this out.

I see access as a problem, I see parents being able to direct their child's education. And they are already in the lower 25 percentile, meaning a lot of those parents did not finish high school and could not finish their own education. I am extremely concerned that we would put money in their hands and that entire piece of life in the hands of parents who are not qualified to make those decisions. And they don't have the money to put in the difference that their child would need to attend a private school.

52:25.78 – 52:43.10

Now, Joe and I and Guy don't hang around with racists, but in our effort to stop them. I've researched a lot of their stupidity. And one of the arguments is that people of a different race are stupid and dumb and have some genetic limitation.

52:44.74 – 52:58.72

Sound that much different from that one right there. Bunch of idiots can't figure out what to do with your kids. Here's the hilarious part. Lydia Glaze, Georgia State representative, took advantage of school choice by using her money to send their kids to private school.

52:59.60 – 53:02.58

Check this out. I am for private schools.

2Speaker 2
53:02.80 – 53:14.18

All of my children graduated from private schools, but I am not for them. If we take public school dollars and use them for private schools, we pay for it.

1Speaker 1
53:14.76 – 53:29.90

Hilarious public school dollars, Joe, as if they come from the money fairy. It's money taken by force from parents to pay for other kids, to pay for other kids public school. So you're not allowed to take your money, send your kid to a private school like she did, we'll just confiscate it and give it to other parents instead.

53:31.46 – 53:41.88

People are so stupid, man. It's old is new again, folks, segregation's back, the left's loving every second of it. Hey, thanks again for tuning in.
