Helping to secure the blessings of liberty to ourselves and our posterity, this is the Constitution Study on the America Out Loud Network, with your host, Paul Engel.
Now that Biden has dropped out of the race, we really shouldn't be surprised if he doesn't take some, we'll call them, parting shots as he goes. After all, he is the ultimate lame duck. Hello there, everyday Americans. Paul Engel, here with the Constitution Study, where we read and study the Constitution, teach the rising generation to be free. I'm so glad you could join me today.
It's been a little crazy. Been a lot of news going on that I've been dealing with and answering questions and doing interviews, and I love being busy. I'll give you that. I love being busy, but I also love coming back and spending some time with you, wonderful people here. So let's take a look at some of these parting shots may actually have been thrown before the announcement of Biden jumping out of the race.
Then again, I don't know when they actually decided it. It's likely that the decision was made before the announcement. So who knows whether these are directly related or not. One that may not be directly related is, well, another $1.2 billion in student loans that Joe Biden wants to use to bribe 35,000 public service workers in an effort to get them to, I assume, vote for the undemocratic party. Yeah, I'm starting to call them the undemocratic party because, as we've seen, especially since the Biden's announcement, they don't follow democracy.
They're not even a democracy. They run themselves like a republic.
When they had primaries and people thought they were electing a candidate, no, they were allocating delegates that would eventually vote for a candidate. Guess what? If you're a Democrat and you voted for Joe Biden in a primary, you don't get your way. So much for we, the people. But we come back to the student loan thing, and this has been an ongoing.
Well, this last one, maybe a later shot, this is something Biden has been doing for years. And again, it really is just the bribe of the American people. In this case, public service workers to get them to vote for the undemocratic party, as, in exchange for paying them off, giving a deal, greasing a few palms.
I mean, let's face it. This is just Joe Biden taking advantage of the unconstitutional acts of previous Congresses. that said, hey, we'll start issuing loans. Does the Constitution authorize us to hand out loans? Not at all, but we'll do it anyway, because, let's face it, who's ever going to hold a member of Congress accountable?
Not the way things look here. Boy, how do you know?
And let's see. Another flaming bag of dog poop that the Biden administration is leaving behind. is this whole Secret Service nonsense. Not nonsense of the Secret Service. It's the mess they made with the Trump protection and the attempted assassination exposed it.
So now we have the Department of Homeland Security Inspector General opening an investigation into.
how Secret Service handled the Trump campaign event back on July 13th. Now, again, this isn't exactly new. One, it was announced. Two, we pretty much expected it. When you have that type of failure, there's going to be an investigation.
Congress took about half a nanosecond to decide they were going to step into this and have their little kangaroo courts.
But the announcement that there's going to be an investigation,
it's really less about the investigation. It's to look at who's doing this. Now, the Secret Service is part of the Department of Homeland Security. I was having a talk this past weekend on a conference call, and people on the call didn't realize this, that the Secret Service does more than just protect the president, because the Secret Service actually started out in the Treasury Department. The Secret Service's first job was to deal with counterfeiting of American money.
I believe that's still their responsibility. It's their law enforcement arm that deals with counterfeiting. But after, I believe, the assassination of Lincoln, they were also assigned the duty of protecting the president. I don't remember why it came out of the Treasury Department, but that's the way it was. Until fairly recently, the Secret Service was part of the Treasury Department.
It would have been the Treasury Inspector General who's overseeing this. No, but this is Department of Homeland Security. Yeah, the same Department of Homeland Security, Secretary Mayorkas,
the FBI, the ATF, all of the DOJ, they're going to be the ones doing the investigation. Now, technically, an inspector general is supposed to be separate from the agency they inspect.
But this does still smell a bit like the fox inspecting the hen house after they've eaten half the chickens. Now, of course, a lot of pressure has been coming down from certain political areas about Secret Service Director Kim Cheatle, and I think for good reason. Now, one of the reasons is Director Cheatle instituted a program to get 30% of agents to be female by 2030.. Now, here's the problem I have. I don't have a problem with women agents.
I have a problem with agents, with less qualified agents being chosen simply because they're women. I have a problem with the physical standards,
the physicality testing being easier for women than it is for men. And people say, but, Paul, women don't have the same upper body strength in general. I understand that. That's the point. It's not that they should be denied.
But when you place politics above the safety of American dignitaries, whether it be the president, the vice president, the First Family, high-level members of Congress, foreign dignitaries, when politics supersedes the job of protecting people's lives, there's something seriously wrong. Now, there are plenty of calls for Ms. Cheatle to resign. I mean, to me, that would have been the honorable thing to do. She said the buck stopped with her, but she's not apparently taking any real.
hits for this. She's not really taking responsibility for this. And I will never forget, of all the pictures shown of the immediate aftermath, the Donald Trump and the fist in the air. And the one I will never forget is when he first stood up and the agents were swarmed around him and I could see his head because the agent at that side was too short to cover Donald Trump. Another agent had to bring their arm in to provide some sort of cover for Donald Trump's head because the agent was too short.
And if there had been a second sniper, if there had been a sniper from that side, boy, I mean, they had a perfect shot at Donald Trump's head.
Could it be because the agent was chosen because it was a female?
Could it just be, well, you know, it was my turn.
If you're not tall enough to do it, I don't care if you're a guy or a gal. I don't care if you're a man or a woman. If you're not tall enough to cover the principal, you don't belong on the detail. Not as a standing, not as an agent expected to throw their bodies in the way. Listen, it takes a lot of guts.
It takes a lot of bravery. You're willing to do that, to train to do that. But it should take, you know, if that is your focus, if you're willing to throw your body, your life in the way to save someone else, then you should be, harden the term, man enough to say, I'm not the right person for the job. I'm not big enough. I'm not strong enough.
I cannot do the full job. You should be.
Sadly, maybe some aren't. Okay. Here's another parting shot from Mr. Biden. Of course, you have all the green initiatives, right?
This, you know, fallacy that, you know, the world's going to end in a few years if we don't get rid of all the plant food. You have the carbon dioxide, the plant food. God forbid, we're going to die from too much plant food. So again, we had the Biden administration. They're doing all sorts of ESG investing and playing with retirement plans.
Well, Fifth Circuit Court of Appeals looked at the decision from a Department of Labor rule that would basically say pension plan fiduciaries, well, they can invest in retirement funds that promote ESG. Well, climate change, yeah, ESG, all this stuff. You know, the ones that the private sectors had set up, the ones that weren't performing, as well as other funds. The ones where people actually started getting in trouble for. Well, this Biden rule overruled a Trump rule that barred companies from using ESG factors in evaluating pension plans.
So we've got the administrative badminton going back and forth. Well, again, the Fifth Circuit Court of Appeals got in and said, you know what,
they've basically told a Texas judge, you've got to take a look at that rule. you upheld. See, the Department of Labor set the rule. A Texas judge upheld the rule. And now the Fifth Circuit's telling the Texas judge, you really got to go back and take a look at this.
because Chevron deference has been overturned. I've talked about Chevron deference. I've got an article about Chevron deference. Not sure if it's on the website yet or not, but you can look for it. And Chevron deference, it was a 1984 opinion that said, when Congress is silent or ambiguous in writing law, the executive agency gets to decide.
And the court said, where, in God's name, did you get that? Not only, the assumption was, the statement from the 1984 court was, well, that's where the experts are. They're administrating the law. They should know what Congress meant. They even went so far as to say, obviously if Congress didn't say anything, they meant for them to do.
that. Pulled that one out of a dark place. And the current court looked at it and said, you know what? Not only is that not what Congress said, not only is that a violation of the Constitution, it's a violation of federal law. Because in 1946, Congress passed the Affordable Care, I'm sorry, the Administrative Procedures Act, and specifically said, if legislation is in question, it's the courts that decide.
So that overturned that one case, which I talked about, big deal. We're seeing it begin to impact other cases where you've got this pension plan rule that was made up by the Department of Labor because they looked at the law and said, well, they didn't say we can't, so let's just make it up. And now we'll see where it goes. Does this Texas judge look at it and say, hmm, you know what? Maybe it wasn't in there.
Maybe Congress was silent. Doesn't mean that the agency gets to decide. If not, does the Fifth Circuit step in and say, well, wait a second. Chevron, the overturning of Chevron means you can't do this.
So, you know, it's interesting. So we've got the, and let's say we got both the Biden promotion of racist, sexist, anti-science rhetoric over common sense, logic, and reason. And now we're seeing the court overturning one case that's now impacting the case involving those rules. So it's a bit of a good news, bad news. The bad news is the Biden administration left a lot of these administrative agencies setting up rules that were not authorized by Congress, that are not constitutional.
The good news is, well, at least based on one court opinion or a couple of court opinions, we may start seeing the courts pushing back on these unconstitutional actions. It's still slow. We're still at the beginning. We're still dealing with a lot of these parting shots from the Biden administration. Many of which, by the way, aren't necessarily parting shots.
They're just plain shots.
And, to be honest, I expect more. I always knew there were going to be fallout from the Biden administration. There's fallout from every administration. The question is, how nasty is Biden going to get now? I don't know.
We'll find out over the next few months. The man's still president. That's, of course, a big question. If he's not capable of running four offices, he's still capable of holding the office. Of course, again, you got the whole 25th Amendment nonsense.
You're never going to get his vice president and his cabinet to vote him to be incompetent. So yeah, we're kind of stuck with things. Consequences of our actions, consequences of our decisions. Sadly, it's when we avoid the consequences that we fail to learn the lesson. So let's take this.
Let's continue forward. Let's take those body shots. Let's take those parting shots. Use them to use the tools that the Constitution has given us, especially some of the ones that the Supreme Court has helped support for us, and use them to protect our rights. And let's take this as the opportunity to reconsider how we choose who our public servants are.
Let's choose people who are actually serving us, that are actually supporting the Constitution of the United States. Let's pick people that are wiser. And let's not focus so much on Congress and the president. What are you doing in your local government, your state, your county, your town? What are you doing there to make sure that they are following the Constitution?
They are fulfilling their oath to support the Constitutions of their state and the United States. Let's just not take the blows. Let's learn from the blows. And see what we can do to make America better.
Now, before I head off to this break, I want to remind you, you know, Constitution Study exists because we're trying to teach people. But we live in a real world where things cost money. Welcome back, Everyday Americans. You've rejoined the Constitution Study, and we're looking at some of the parting shots. Again, some of them are recent, now that Joe Biden has withdrawn from the race, but some of them, well, they come from earlier in his administration. And the push towards, well, let's just say there's been a push of illegal aliens, an unwillingness to enforce federal law, and that's a whole other kettle of fish. What I actually want to focus on is actually an Arizona law.
See, Arizona was at 16-121.01 says that if you register to vote in Arizona and you don't provide proof of citizenship, the registration will be rejected. Now, there was an injunction put in place preventing that law from being enforced and forcing the state to register those applicants as federal-only voters. Okay, problem number one. Federal-only voters. First of all, the only federal election we have, the people don't vote in.
It's the presidential electors. Every election that people vote in is a state election. It's the state members of the House of Representatives, the state members of the Senate, and it's the state presidential electors. Now, under the Constitution, Congress can modify the time, place, and manner of elections for House and Senate, but only for House and Senate.
Now, to me, what's interesting is the Ninth Circuit Court of Appeals, arguably known as the least constitutional circuit in the entire country,
allowed the state to stay, the decision of the district court that prevented the law from going into effect, saying that the applicants for state registration can require proof of citizenship and that if they do not provide such, they cannot be registered to vote in that state. So again, there's been a lot of questions, a lot of talk about elections lately. There's been a lot of talk about non-citizens voting, and of course, the Constitution doesn't say anything about that. Then again, the people vote in state elections, and the states have control over this. And yeah, I believe the states should have, not just laws, I'd love to see them pass constitutional amendments requiring citizenship as a requirement for voting in elections within the state.
But only a handful of states, I believe, actually have such amendments or such constitutional guarantees in place. So again, we have a parting shot, a question shot across the bow about non-citizens voting. And we actually have the Ninth Circuit. I've used a derogatory name for them in the past, and I won't, because this is a good, to me, this is a sound argument. It's not simply that I agree with it.
It's based in sound Constitution and law. So this is good news. And I think it's important that we recognize that, yeah, not all of the shots that were taken were able to block some of them. Here's a block. No, the case isn't done.
This is only a stay on its enforcement until the facts of the case can be heard and decided. Now, one of the big parting shots actually didn't come from the administration, but it certainly was pushed by the administration. And that is ballot drop boxes. Now, to me, ballot drop boxes are, they're a nightmare. And it's all about the chain of custody, right?
It's the, you know, if you, when I vote, I go to a polling place, my wife and I go to a polling place. We show our IDs. We get our ballots. We go to the machines. We cast our votes.
We hand the ballot, or, in many cases, in our case, it's just a card to a poll worker. That ballot is never out of our possession. From the time it is issued to the time the vote is cast, it is never out of our possession. Very important. Now, we've had mail-in voting, and I've done absentee voting once in my life.
I was doing a project. I was out of state on election day. This was before we had election month, but I was out of state on election day. So I requested an absentee ballot. I provided a reason why, and I filled it out, and I mailed it in.
And voila. I don't particularly like mail-in ballots because, again, that ballot is out of my control. It is sent to me. It's out of the ballot, the county's control. It's sent to me.
I then fill it out. It's out of my control, going back to the county for counting, and I don't particularly like that. There's some security around it, but I'm not real thrilled. Drop boxes. Well, drop boxes to me are just as bad.
I don't know if they're worse than mail-in balloting, but they certainly were abused, apparently, in the 2020 elections. There's video evidence of people in states where it is illegal to drop off ballots, for people other than family members stuffing ballot boxes with tens, if not hundreds, of ballots. And it's a problem. And it's a problem that a lot of people just seem to want to ignore. Well, two Wisconsin lawmakers have introduced legislation that would require the cities and counties that use drop boxes to have them under 24-7 video surveillance.
I love people going, yay, hey, well, actually, they'll actually be watched. Doesn't do you any good.
Because video surveillance doesn't stop people from walking up and stuffing ballot boxes. And once they stuff the ballot box, you have no way of knowing which ballots they illegally cast, which means you're stuck between two bad decisions. Either you count ballots that you know were illegally cast, or you don't count all the ballots because the ballot box has been contaminated, therefore, people who actually did legitimately vote through that ballot box, their votes don't count.
Now, one of these people, the state representative, Scott Krug, he said, this bill is a start towards standards that make sense. Okay, I like that. It's a start. Okay. He said, we should all be concerned that anything happening with drop boxes incorporates basic principles of ballot security and transparency and record keeping.
Anything short of standardized rules for all is unacceptable. I rely on our clerks to make good decisions, but the lack of directives here invites criticism and creates concern. Okay, this is a start. I don't think it solves the problem.
Okay, so again, the problem we run into is you observe a crime, but do you have any evidence you can use to, A, charge the person who committed the crime, or B, rectify the problem? The answer to both of those is no. So it's a small step for ballot integrity. It's a small, minuscule, a very small step for ballot security. But it's at least a step.
My concerns are these two state senators and their colleagues going to look at this and say, all right, we've solved the problem. We just have 24-hour surveillance and voila, everything's fine. Do they think that's the solution to the problem? Because I know that's not the solution to the problem. But as long as we're talking elections, I got one more for you.
Now again, 2020 elections, we saw a lot of social media influence and interference in the election process. Promoting some information, suppressing other information. They meddled in the election. And I remember when Elon Musk bought Twitter, he said, no, we're going to get rid of, he wanted to be a free speech zone. And he then changed the name to X so that he wouldn't even be associated with the name Twitter.
Well, guess what? Twitter's not done.
According to the Media Research Center, they've done some research on what's been going on with X. And they say that X is AI chatbot Grok. Well, they say, according to the algorithm, that Grok tends to promote Democratic members of Congress and suppress information from Republicans, both in the House and the Senate. That they're not equal in how they treat the members of Congress.
They say that more right-leaning congressional members have a lower visibility on X, while left-leaning congressional members have a higher visibility on X. And they provide some examples, right? So Maxine Waters, leftist, I would say beyond vocal, right? I would say antagonistic. I'd actually say malicious.
Malicious member of the House. Very leftist, very Marxist. Told people to go out and get in people's faces in restaurants if they happen to be part of the Bush, or the Trump administration, and they just want to go out to dinner. She's telling people to get in their faces. She is the highest ranked House member by the X algorithm.
That's right. The crazy out there leftist. Chuck Schumer, another devout leftist. He's the number one, they call him the king of Congress by X's algorithm.
Speaker of the House, Mike Johnson, on the other hand, eh, not so much. For example, the X algorithm apparently considers Mike Johnson to be more toxic than the anti-Semitic representative, Ilhan Omar. You know, the one that was all supporting the Pearl Hamas demonstrations and was all upset with when Israel actually defended themselves.
So, yeah, X is still, they may not be as bad as the bad old days, but they're still there. Which tells me, again, tells me a lot. I'll put a link to the study in the show notes. when they post to the website. You can check it out yourself, read the details, find out.
To me, again, it shows why I don't get my news and information from X or from any social media platform, for that matter. I mean, I do watch certain people on YouTube and Rumble, but I'm always double-checking their facts. I don't simply trust them for what they say.
I guess that's a lesson. maybe not enough people have learned, at least not in my opinion.
But this use of social media, actually, a lot of it goes back to, I believe, the Obama administration. But again, we're dealing with the aftermath, the parting shots of the Biden administration. And it extends beyond, I think, what a lot of people think. You know, unemployment, inflation, debt. Yeah, those are all fairly obvious, but there are others.
And we're going to be dealing with these consequences for years, if not decades. Think too often, we keep looking for the quick fix. And in doing so, we forget the long-term impact of our decisions. Let's face it. We may not have voted for, individually, may not have voted for Joe Biden.
And there's even a question about whether a majority of the people of the country voted for Joe Biden. Actually, they would have voted for electors for Joe Biden.
But from what I've seen, the, yeah, several states screwed up, but they screwed up and they left us with this mess. And we're going to be cleaning it up for years. All the more reason to be more cognizant of who you choose, not just at the federal level. Remember, each and every election starts with a county election board. Who is on your county election board?
Are they honorable people? Are they public servants? They see themselves as public servants or as public masters, knowing better and making sure that the right people get in. How about your state laws, about election laws and how biased they are towards the political parties, especially Republicans and Democrats? Have you considered that?
Have we elected people at the state level that will maybe deal with some of the bias that has been built into the state election law? Again, we, the people, believe it or not, in the United States, we are sovereign. But that only works if we actually act that way. If we take responsibility for our decisions, if we learn from this and say, OK, we've learned, let's do better next time. Don't pretend it never happened.
Don't ignore it. Don't sweep it under the rug. Look the ugliness right in the eye and learn your lesson from it. You know, I remember when my, when my daughter was little, I used to tell her that she would always get into more trouble covering up the mistake than telling me about it in the first place. You know, whether you, you know, I don't care if you broke something.
I don't care if you make a mistake, if you lie, if you do something bad, if you break something, if you tell me, you'll get in much less trouble than if you lie to me about it. That's kind of the same thing here, right? We made a mistake and we've spent four years suffering for that mistake. Now, not everybody suffered. Some people have loved what came along, but as a whole, the nation has suffered for the mistake.
Learn from it. Take those body blows and then learn from it, so that we don't do it again. That's the trick. It's doing the same thing over and over again, expecting a different outcome. that Einstein said was the definition of insanity.
Okay, I have another break coming up. Before I go, though, you know, I've been, I just got off the phone with Patriot Mobile. I had a small issue to deal with, and it was great. I called them up and I talked to a real live human being based right here in the good old U.S. of A.
And she quickly fixed my problem. And I mean, a few minutes later, bam, I was back off and I was up and running. Best of all, when I spend money with Patriot Mobile, it isn't used to take away my rights. It's used to support companies that believe what I believe. Because Patriot Mobile is America's only Christian conservative wireless provider.
I get great 4G and 5G coverage on all the same networks I do with the major carriers. I get to deal with 100% U.S.-based customer support. And I know that the money I pay them for their service, they don't turn around and use to attack my rights. They support organizations that are fighting for religious freedom and constitutionally protected rights, including, by the way, the Constitution Study. Now, if you switch to Patriot Mobile now, you can get free activation with the offer code CONSTITUTION.
Just go to patriotmobile.com slash CONSTITUTION, find a plan that works for you. And, when you check out, use that code CONSTITUTION to get free activation. You can, too. Take those stories and articles, the podcasts and the videos, the things that have this great information, and share them. Believe it or not, it's not simply sharing information. You're helping to share the blessings of liberty.

Welcome back every day at American Injury. Join the constitution study. We've been talking today about parting shots from Mr. Biden. Let's take some time and look at some of the stuff going on in the states.
And well, I gotta say, it's gonna be dealing with some of the sexual stuff. In New Hampshire, Governor Sununu signed two bills dealing with,
well, one dealing with males participating in female youth sports and the other is the actual carrying out of sex change surgeries for minors. I say quote unquote, because these surgeries don't actually change a person's sex. They simply modify the body. So the first bill, HB 1205, also known as the Fairness and Women's Sports Act, scheduled to take effect August 19th and require all sports teams for grades five through 12 to designate athletes by sex and to prohibit biological males who have transitioned to females from participating in female athletics. I know some people are going to be, wait a second, if they've transitioned, the problem you run into is
there's still a biological difference even after transition. If they do the transition before puberty, it's much less. But then again, you're talking about, how young are we going to be? chopping off perfectly healthy body parts from boys and girls? So that's, again, I said, scheduled to take effect August 19th.
I wouldn't be surprised if someone sues and they try to get an injunction and all of that.
And compare that to what this actually does. It allows students who are men to be on men's teams or boys teams, females to be on girls teams, or co-ed or mixed, if it's deemed appropriate. Yes, the students will be required to provide proof of their biological sex through their birth certificate.
But in a nod to how crazy we've created the language, the students now require proof of their biological through their birth certificate, showing their gender at or near the time of a student's birth. Memory serves most birth certificates. I've never looked at, I can't say I've looked up the birth certificates in New Hampshire, but the birth certificates don't identify gender. They identify sex. So I don't know.
That's where New Hampshire is. Now, HB 1205, according to the governor, is designed to make sure there's fairness and safety in women's sports. And to me, that's a good thing. Now, HB 619 is the ban from medical providers for carrying out what they call genital gender reassignment surgery. Now, this is for those under 18 years old, right?
So it's not everybody under 18 year olds would be banned. And what's interesting to me about this is it's failure to do so will be labeled as unprofessional conduct, which means both the minor and their parents can actually sue a doctor who carries out the procedure up to two years after. And it also allows the licensing boards to discipline doctors. Now, let's move now to Tennessee. I adopted home state.
Yes, I'm a volunteer now. Last year, Governor Lee signed a bill known as the Tennessee's Adult Entertainment Act. This act prohibits adult oriented performance that are harmful to minors from being performed in public or areas accessible by children. It identified adult cabaret entertainment or defined it as topless dancers, go-go dancers, exotic dancers, strippers, male or female impersonators or similar entertainment. Now, a first offense was classified as a Class A misdemeanor, while subsequent offenses would be considered Class E felonies.
Now, a group called the Friends of George, a theater organization that does drag shows, challenged the Adult Entertainment Act as being facially unconstitutional. They sued in federal court. The district court agreed. They declared the AEA unconstitutional in its entirely and permanently enjoined District Attorney General, District AG Stephen Mulroy, from enforcing it anywhere within the court's jurisdiction, which is basically it's Shelby County, it's Memphis, Tennessee. Now, this was then heard, this was heard by a Sixth Circuit Court, a panel of the Sixth Circuit Court, where not only was the.
First Circuit decisions reversed and it was remanded with instructions to dismiss. See, the Circuit Court said that the Friends of George did not have standing, that they never met the burden of showing that they were legitimately harmed by this law. Now, what's interesting is the Friends of George sought an injunction claiming it violated their First Amendment rights. Well, as ignored by the court, this cannot be a First Amendment issue because this is a Tennessee state law, not a law passed by Congress. The first five words of the First Amendment say Congress shall make no law.
Congress did not make this law. Therefore, it's not a First Amendment issue. Now, they may have claimed it was a free speech issue under the Tennessee Constitution, but that's not what they did. Now, that doesn't mean I'm overly happy with the Circuit Court, what the Circuit Court found. And for one primary reason, they never looked at the merits of the case.
They simply said, Friends of George had not actually been harmed yet. Therefore, they had no right to sue. And that to me, I sort of understand the rationale of we don't want everybody and their uncle suing whether they'd be harmed by a law or not. But I also don't like the idea of, listen, you actually have to break the law and chance a criminal record in order to challenge what you believe to be an unconstitutional law. I think there should be a scenario where you can challenge a law before you actually have to commit a crime to do so.
There needs to be something between those. But I also think we need to recognize what the state of Tennessee is trying to do, because again, they're focusing on what could be harmful to children. And while there may be some disagreements about what is and is not harmful to children, when you're talking about public places or places where children congregate,
there has to be some recognition. We all don't agree, but the majority of people get to decide. In other words, you can't have an effective, basically a heckler's veto. One person disagrees, so everybody has to go along with it. Doesn't, that's not the way this was set up.
The Constitution of the State of Tennessee, the Constitution of the United States understand that majority rules. In a republic, the majority rules. Now we protect the rights of the minority, but we still have to remember the majority rules. And to take us back to the beginning premise, that's why we, all legislative power, all power for making laws in the United States or at the federal level, is vested in Congress. It's not in the administrative branch.
It's not in the courts. So when an executive officer, say a chief executive, a president, uses the executive agencies to effectively write law, make up law, make up policy, they're not simply violating their oath of office. They're not merely committing a bad behavior, a misdemeanor. They are actually overthrowing the government. They're not recognizing the basic structure of the United States as a republic.
If you cannot get a majority of the representatives of the people to agree to something, you don't get to write it up on your own. Just because you have a pen and a phone does not make you a king. We saw this under Obama. We saw this to some extent under Bush. And under Trump.
And we saw it under, we've seen it under Biden. And we are still living with the consequences. We've seen it going all the way back in my life to Nixon.
I'm sure it went back farther than that. In fact, I can bet you I can go all the way back. We can go to FDR. Maybe all the way back to Woodrow Wilson.
But the majority rules. It is a representative government. Their legitimate powers come from the consent of the governed. So a lot of the hearting shots we're getting from Mr. Biden are simply the way we've taught politicians to do business.
When in doubt, just do it now and ask forgiveness later. What's the line? It's easier to ask forgiveness than to ask permission. It's kind of where we get stuck. Then we spend years in courts and court costs and to finally find out, nope, guess what?
They were wrong. And thankfully, the Adult Entertainment Act here in Tennessee took about a year. Could have been a lot worse. Could have been Chevron, where we spent 40 years, or Roe v. Wade, where we spent 50 years dealing with the parting shots of different organizations that simply decided they wanted to get their way.
Well, yeah, we're going to get more of this. We're going to have to live for a long time with the outcomes of the Biden administration. But are we going to learn from that?
Now, listen, who knows? At this point, I wouldn't even hazard a guess as to what comes next, because, let's face it, the entire election process has been corrupted by the political parties so badly, most Americans don't even understand, don't even know what the Constitution says about how we elect a president. They don't know about the process for electing members of the House and the U.S. House and Senate. They don't know.
They look at what's been done and just assume, oh, that's the way it works. That's what the Constitution says. That is not true.
It's one of the reasons why. I'm still planning on it. I'm doing an episode, maybe a segment or two, on the Article 2 and the 12th Amendment and federal law that revolves around the election of the president, because we focus so much on that man. But I also want you to remember the vast majority of the power in this legitimate power in this country does not reside at 1600 Pennsylvania Avenue. It doesn't reside on Capitol Hill or in the Supreme Court chambers.
It doesn't reside in your statehouse, in your governor's mansion. It resides in your city halls and in your county courts, your county courthouses. Let's spend a little more time looking there.
Maybe if we got better people in those positions, they would percolate to the other places. You get better people in the county, you get a more constitutional county, we end up with better state legislators. Better state legislators may end up with better federal legislators.
But we should be learning from what we've been experiencing the last few years. The question is, what lesson are we going to learn? Are we going to learn to win at all costs, damn the laws, full speed ahead, stuff the ballot boxes, lie, cheat, steal, and then, when you're in power, do whatever you can. Use the executive branch, use the courts, do whatever you can to get whatever you can while you can, because you've got a limited time to play tyrant.
We're going to learn the lesson that tyranny is not good. Even when you win, you lose.
So that's the lesson that I took away from the last several years. And I fully expect Joe Biden to leave us some parting shots as he leaves the stage. What those are, eh, that'd be mere speculation.
But the one thing I also want to remember is that the United States of America isn't founded in Washington, D.C. That's the seat of the government, but it's not the foundation of the nation.
See, if we wish to be the land of the free, we must be the home of the brave, brave enough to live free, brave enough to decide for ourselves, brave enough to look a government actor in the eye and say, no, that's not lawful, that's not constitutional,
that's null and void. Oh, by the way, you're now the one committing the federal crime. How do we do that? The way John Jay told us, we read and study the Constitution of our country. We teach the rising generation to be free so that we know our rights.
We quickly recognize when they are violated and we have prepared to defend and assert them. We don't figure it out at the last moment. We prepare ahead of time. The body will not go where the mind has not been.
Sure, is it less than fun to think up scenarios and how you would deal with them? To look at what's been going on in the world and say, well, what would I have done? Can't say that it's fun, but it's important.
because you don't want to be that person facing that ATF agent or that FBI agent or that state police officer that has a badge on one shoulder and a chip on another, and then try to figure out what you can do. Prepare ahead of time.
